The Treaty is as controversial today as it was in 1989 when "Waitangi: Māori and Pākehā Perspectives of the Treaty of Waitangi" was published. It remains central to debates about New Zealand society and its future. Among new issues to emerge in the last fifteen years are the inclusion of the Treaty in a large range of legislation, greater recognition by the Crown of its duty to recognise the Treaty, and the transformation of the claims process. The contributing authors provide a range of perspectives on the social, legal, and historical impact of the Treaty, and address the issues that have emerged over the 1990s and into the twenty-first century.

Beyond Biculturalism: The Politics of an Indigenous Minority is a critical analysis of contemporary Maori public policy. O'Sullivan argues that biculturalism inevitably makes Maori the junior partner in a colonial relationship that obstructs aspirations to self-determination. The political situation of Maori is compared to that of First Nations and Aboriginal Australians. The book examines contemporary Maori political issues such as the 'one law for all' ideology, the Foreshore and Seabed Act 2004, Maori parliamentary representation, Treaty settlements, and Maori economic development.

"The Treaty of Waitangi was signed in 1840 by over 500 chiefs, and by William Hobson, representing the British Crown. To the British it was the means by which they gained sovereignty over New Zealand. But to Maori people it had a very different significance, and they are still affected by the terms of the Treaty, often adversely. The Treaty of Waitangi, the first comprehensive study of the Treaty, deals with its place in New Zealand history from its making to the present day. The story covers the several Treaty signings and the substantial differences between Maori and English texts; the debate over interpretation of land rights and the actions of settler governments determined to circumvent Treaty guarantees; the wars of sovereignty in the 1860s and the longstanding Maori struggle to secure a degree of autonomy and control over resources." --Publisher.

Historical Frictions written by Michael Belgrave and has been published by Auckland University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-10-01 with Law categories.

Historical Frictions explores the role of the courts and of various types of commissions in mediating and reinventing historical narratives of colonisation. Author Michael Belgrave shows how the courts became from 1840 places where different narratives of discovery and conquest, of loss and displacement and of claims to resources and mana were debated. These legal debates were not only between Maori and Pakeha; Maori also used the courts to maintain or reclaim traditional rights between Maori and Maori. From this perspective the Waitangi Tribunal is less radical than is often supposed and is seen to be carrying on a similar function to earlier tribunals and courts in the transformation of historical narratives. Historical Frictions covers a number of issues, all of which have been before the Waitangi Tribunal, including the Old Land Claims, the Kemp Purchase, confiscation, the Orakei Block, the Whanganui River, fisheries, the Chatham Islands and the Wellington Tenths claim.

Being Maori In The City written by Natacha Gagné and has been published by University of Toronto Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-01-21 with Social Science categories.

Indigenous peoples around the world have been involved in struggles for decolonization, self-determination, and recognition of their rights, and the Māori of Aotearoa-New Zealand are no exception. Now that nearly 85% of the Māori population have their main place of residence in urban centres, cities have become important sites of affirmation and struggle. Grounded in an ethnography of everyday life in the city of Auckland, Being Maori in the City is an investigation of what being Māori means today. One of the first ethnographic studies of Māori urbanization since the 1970s, this book is based on almost two years of fieldwork, living with Māori families, and more than 250 hours of interviews. In contrast with studies that have focused on indigenous elites and official groups and organizations, Being Māori in the City shines a light on the lives of ordinary individuals and families. Using this approach, Natacha Gagné adroitly underlines how indigenous ways of being are maintained and even strengthened through change and openness to the larger society.

The essays in this volume reflect the exciting new directions in which legal history in the settler colonies of the British Empire has developed. The contributors show how local life and culture in selected settlements influenced, and was influenced by, the ideology of the rule of law that accompanied the British colonial project. Exploring themes of legal translation, local understandings, judicial biography, and "law at the boundaries," they examine the legal cultures of dominions in Canada, Australia, and New Zealand to provide a contextual and comparative account of the "incomplete implementation of the British constitution" in these colonies.

The Earth Charter Ecological Integrity And Social Movements written by Laura Westra and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-06-20 with Law categories.

The Earth Charter is a declaration of fundamental ethical principles for building a just, sustainable and peaceful global society, with ecological integrity as a major theme. This book provides a series of analyses of ecological integrity as it relates to the Earth Charter, social movements and international law for human rights. It is shown how the Earth Charter project began as a United Nations initiative, but it was carried forward and completed by a global civil society initiative. The drafting of the Earth Charter involved the most inclusive and participatory process of its time ever associated with the creation of an international declaration. This process is the primary source of its legitimacy as a guiding ethical framework. The Earth Charter was finalized and then launched in 2000 and its legitimacy has been further enhanced by its endorsement by over 6,500 organizations, including many governments and international organizations. In the light of this legitimacy, an increasing number of international lawyers recognize that the Earth Charter is acquiring the status of a soft law document. The book also shows the strong connection between ecological integrity and social justice, particularly in the defence of indigenous people, and includes contributions from both the North and the global South, specifically from Central and South America.

Managing Responsibly written by Venkataraman Nilakant and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-05-13 with Business & Economics categories.

In the wake of financial meltdown and environmental disaster, employers increasingly demand that managers have an understanding of ethical decision making, corporate social responsibility and values-based management. Business ethics is therefore increasingly being taught in business schools and is a rapidly developing research topic. Managing Responsibly explores the limitations of the thinking that dominates Western corporate and business culture. Contributors then draw on non-Western traditions and experience to suggest workable inter-cultural models to enhance organizational effectiveness in an increasingly globalised environment. With chapters written by specialists in economics, management, ethics, health sciences and history, the editors - one a historian and one a management specialist - ensure a truly interdisciplinary overall approach. Part One highlights the acute need for less self-interested approaches to management if local and global communities and the environment are to escape on-going damage and exploitation. Part Two draws on values from Indian and Maori traditions to propose alternatives to Western models of business ethics. Part Three suggests ways of approaching the challenges of developing sustained ethical leadership in the contemporary globalised economy. This original addition to Gower's Corporate Social Responsibility Series will appeal to a wide range of teachers, researchers and higher level students of management, as well as practitioners participating in executive development programmes. It will also serve the needs of those with a more specialist interest in business ethics and in sustainable and responsible management.

This book brings together a series of papers by Ani Mikaere that reflect on the effect of Pakeha law, legal processes and teaching on Maori legal thought and practice. She discusses issues such as the ability of Maori to achieve justice when Maori law is marginalised; the need to confront racism in thinking, processes and structures; the impact of interpretations of the Treaty of Waitangi; the difficulty of redressing harm to Maori within the Pakeha legal system; and the importance of reinstating tikanga at the heart of Maori legal thinking and practice.
