Historical studies on the practice of Islamic law (sharīʿa) tend to focus on practice in a Sunni setting during the Mamluk or Ottoman periods. This book decenters Sunni and Mamluk and Ottoman normativity by investigating the practice of sharīʿa in a Twelver Shiʿi Persian-speaking milieu, in early modern Iran between the sixteenth to twentieth centuries. Drawing on documentary evidence and narrative sources, it reconstructs who the practitioners of Islamic law were, how they authenticated, annulled, and archived legal documents, and how they intervened in the resolution of disputes over religious endowments (waqf). The study demonstrates that following Iran's conversion to Twelver Shiʿism under the Safavids, the dominance of Uṣūlī Shiʿi legal theory, which conferred judicial authority on scholars recognized as Shiʿi jurists (mujathids), affected both the practitioners of Islamic law and the procedures of sharīʿa court practice in Iran. Shiʿi jurists in Iran, as a result, would come to exercise by the end of the nineteenth century a judicial monopoly over valid sharīʿa court practice thus laying the foundation for Ayatollah Khomeini's extension, during the Iranian revolution, of the authority of the Shiʿi jurist over political affairs.

An Iranian Town in Transition deals with the social and economic history of Tabriz, a town in north-west Iran and the centre of the historical province Azerbaijan. The focus of this study is on the notables of the town in an epoch of fundamental change that stretches from the mid-eighteenth to the mid-nineteenth century. Far from narrating a simple history of events, the study addresses major questions related to endowments (waqf), the workings of the Shiite judiciary, urban and provincial administration, the changing role of the 'ulama, and tenure of landed property in concrete case-studies. With its wide perspective on developments in urban society, the study interprets the process of social change in the transitional period from the Zands to the Qajars as a crucial starting point for the modern history of Iran. Stressing the importance of indigenous sources for this period, the author drew heavily on hitherto neglected Persian archival material. A large number of documents, deeds, and court protocols are included in critical edition in the appendix.

This book focuses on Shiraz and the province of Fars to provide a detailed political, social and economic history of Ilkhanid rule from the first Mongol invasions in 1220 until the end of the Injuid Dynasty in 1357. Using a vast collection of sources, Denise Aigle combines local and global approaches to integrate the history of the province into the whole administrative system. Central is the thesis that Mongol rule caused a break in traditional administrative patterns. A dual administrative system was set up, consisting of both Mongol and local Persian personnel, directed from the court. Charting the fortunes of each successive ruler, her research shows that the failings of individual rulers, as well as intriguing by Persian notables, were the principal reasons for Shiraz and Fars's economic decline under the Mongols in comparison with the more successful neighbouring province of Kirman. This book is a study of Islamic architecture in Anatolia following the Mongol conquest in 1243. Complex shifts in rule, movements of population, and cultural transformations took place that affected architecture on multiple levels. Beginning with the Mongol conquest of Anatolia, and ending with the demise of the Ilkhanid Empire, centered in Iran, in the 1330s, this book considers how the integration of Anatolia into the Mongol world system transformed architecture and patronage in the region. Traditionally, this period has been studied within the larger narrative of a progression from Seljuk to Ottoman rule and architecture, in a historiography that privileges Turkish national identity. Once Anatolia is studied within the framework of the Mongol Empire, however, the region no longer appears as an isolated case; rather it is integrated into a broader context beyond the modern borders of Turkey, Iran, and the Caucasus republics. The monuments built during this period served a number of purposes: mosques were places of prayer and congregation, madrasas were used to teach Islamic law and theology, and caravanserais secured trade routes for merchants and travelers. This study analyzes architecture on multiple, overlapping levels, based on a detailed observation of the monuments. The layers of information extracted from the monuments themselves, from written sources in Arabic, Persian, and Turkish, and from historical photographs, shape an image of Islamic architecture in medieval Anatolia that reflects the complexities of this frontier region. New patrons emerged, craftsmen migrated between neighboring regions, and the use of locally available materials fostered the transformation of designs in ways that are closely tied to specific places. Starting from these sources, this book untangles the intertwined narratives of architecture, history, and religion to provide a broader understanding of frontier culture in the medieval Middle East, with its complex interaction of local, regional, and trans-regional identities.
