Congressional legislation requires that all major weapon systems contracts signed after January 1, 1985, contain three types of written warranties: design-manufacture, materials-workmanship, and essential performance requirements. This study reviews the specifics of the law, its legislative history, and Congressional intent revealed in relevant hearings. Through analysis of recent weapon system contracts from all the Services, supplemented by field interviews with contracting personnel, the study ascertains the changes in contractual warranty provisions effected by the mandate. Research is then directed more deeply into the functions of weapon systems warranties and their economic appropriateness in a Department of Defense context.

The objectives of this research were to identify and discuss the background of current warranty policy and its application to the acquisition of spare parts within the Navy Field Contracting System specifically the Navy Aviation Supply Office and the Navy Ships Parts Control Center. As a result of theis research, the conclusions are as follows: (1) Navy policies on warranty development and implementation must be definitized, (2) Spare parts warranty form development should utilize the same decision process as used for weapon system warranties, (3) Weapon systems warranties ultimately drive the type of warranty coverage for spare parts; and (4) Pending a formalized administration and centralized data collection system, spare parts warranties should specify coverage for Materials and Workmanship defects, unless a more complex warranty is dictated by the weapon system program office.

Warranties have been a point of considerable discussion, if not controversy, within the Department of Defense (DoD) acquisition community for over a decade. Use of warranties within defense procurements is not new. What changed was the requirement placed upon DoD by Congress that mandates their use in weapon system procurement. The primary points of contention with defense use of warranties, besides their mandatory use, is whether they are cost effective and practical for use in acquisition of weapon systems. Numerous studies and reports have been published questioning the benefit of weapon system warranties. For the most part, these documents have recommended repeal of the law requiring warranties. The General Accounting Office published a recent report supporting repeal, while citing weapon systems warranties as impractical and not cost effective, which resulted in the government receiving a financial return of approximately 5 cents on the dollar. Mandating warranties for defense acquisition has not been a success. Although warranties in the commercial marketplace have been beneficial, they are impractical and not cost effective for use in defense. It is time for Congress to repeal the warranty statute.

Examines the Reliability Improvement Warranty (RIW). Consumer and commercial warranty experience does not alone justify optimistic expectations for RIWs; the effect of RIWs in completed Department of Defense (DOD) programs is inconclusive; and as a result of inadequate research design the expectation of drawing meaningful conclusions from the ongoing RIW experiment may be over-optimistic. Examination of completed RIW programs, however, suggests the importance of (1) modification after operational use or testing, (2) schedule flexibility, (3) contractor involvement in initial overhaul and repair, and (4) avoidance of RIWs in programs subject to extreme quantity or utilization uncertainty. The design of the DOD's ongoing RIW experiment can be improved by (1) reducing the variation in contractual terms, (2) developing better controlled conditions, and (3) establishing defined limits for the experiment. In addition, the DOD must recognize the multiple objectives of the RIW and establish priority among them to facilitate evaluation.
