English summary: The principle of the defensive democracy is a controversial element in the German constitution. Following the predominantly politically-motivated conflicts surrounding its function and its scope, legal literature in the past years shows that there has been a decline in interest in the possibility of a democracy to defend itself. In connection with the discussions on security after the terrorist attacks on September 11, 2001 and the controversy surrounding the proceedings to ban the National Socialist party in Germany, the general public has once again become aware of the concept of a defensive democracy, and it has become a subject of scholarly interest. Das Phänomen des Rechtsextremismus stellt die Bundesrepublik seit ihrer Gründung immer wieder vor eine besondere Herausforderung und ist auch gegenwärtig ein Problem, mit dem sich die Demokratie auseinandersetzen muss. In diesem Zusammenhang wird immer wieder auf das Konzept der streitbaren Demokratie verwiesen, welches als Lösung für das Problem des Rechtsextremismus dargestellt wird. Doch welche Gefahr geht tatsächlich vom Rechtsextremismus für die Demokratie aus? Inwiefern stellt die streitbare Demokratie eine Antwort auf den Rechtsextremismus dar? Was beinhaltet das Konzept der streitbaren Demokratie, inwieweit dient es zur Bekämpfung des Rechtsextremismus und wo sind seine Grenzen? Ziel dieser Arbeit ist es herauszuarbeiten, warum der Rechtsextremismus eine Herausforderung für die Demokratie darstellt und warum es deshalb eines streitbaren Demokratieschutzes bedarf. Dazu wird nach Klärung des Rechtsextremismusbegriffs auf die verschiedenen Erscheinungsformen des Rechtsextremismus eingegangen. Aufgrund ihrer hervorgehobenen Bedeutung im Bereich des parteilich organisierten Rechtsextremismus steht dabei die NPD im Fokus der Betrachtung. Daneben folgt eine Analyse des nicht-parteilich geprägten Rechtsextremismus, welcher die Demokratie ebenfalls, aber in einer anderen Weise, bedroht. Darauf aufbauend wird das Konzept der streitbaren Demokratie, so wie es in der Bundesrepublik existiert, als Antwort auf die Herausforderung von rechts präsentiert. Nach einer kurzen Einführung in den historischen Ursprung des streitbaren Demokratieschutzes werden die Wesensmerkmale des Konzeptes der streitbaren Demokratie und deren interdependentes Zusammenspiel analysiert sowie deren Instrumente untersucht. Gefragt wird dabei auch nach der Wirkungsweise der Instrumente des verfassungsrechtlichen Demokratieschutzes im Hinblick auf die Bedrohung durch den Rechtsextremismus. Die Frage nach der Effektivität der streitbaren Demokratie als Konzept zur Bekämpfung des Rechtsextremismus soll abschließend im Resümee beantwortet werden. Hier werden die Grenzen des verfassungsrechtlichen, streitbaren Demokratieschutzes dargestellt und Auswege aufgezeigt.

Democracies across the world increasingly find themselves under threat from enemies, ranging from terrorists to parties and movements that undermine democratic institutions from within.
