Studienarbeit aus dem Jahr 2008 im Fachbereich Politik - Internationale Politik - Klima- und Umweltpolitik, Note: 1,7, Universität Kassel, Sprache: Deutsch, Abstract: In der vorliegenden Ausarbeitung zum Seminar "Regieren in Europa - Europäisches Regieren" befasse ich mich mit einer Analyse der Probleme, die es für Deutschland bei der Umsetzung der europäischen Umweltpolitik gibt. Zunächst wird die Umsetzung der europäischen Umweltpolitik in Deutschland, Großbritannien und Frankreich betrachtet. Danach stelle ich die Implementationseffektivität der genannten Länder vor und konzentriere mich im weiteren Verlauf der Arbeit nur noch auf Deutschland. Es folgen Erklärungen und Erfolgsbedingungen für eine effektive Implementation. Schließlich endet die Arbeit mit einer abschließenden Bewertung. Die Umweltpolitik der Europäischen Union hat in den vergangenen drei Jahrzehnten eine beachtliche Entwicklung durchlaufen. Es lässt sich seit Beginn der 70er Jahre eine Ausweitung umweltpolitischer Aktivitäten auf europäischer Ebene beobachten, die sich auf alle wichtigen Bereiche des Umweltschutzes erstrecken. Profitiert hat die Entwicklung der europäischen Umweltpolitik von der wechselnden Führungsrolle einiger Mitgliedstaaten. Besonders Deutschland hat in den 80er Jahren auf eine Reduzierung der Emissionen gedrängt und somit die EU-Umweltpolitik entscheidend beeinflusst (vgl. Knill 2008). Traditionell war die Bundesrepublik einem regulativen Ansatz, das heißt sie bevorzugte Steuerungsinstrumente wie Gebote und Verbote, für den Umweltschutz verpflichtet. Besonders im Bereich der Luftreinhaltung war das europäische Umweltrecht vom deutschen kopiert (vgl. Sturm/Pehle 2006). 1987 wurde schließlich die Umweltpolitik mit der Einheitlichen Europäischen Akte (EEA) als offizielles Handlungsfeld der Gemeinschaft im EWG-Vertrag verankert (vgl. This book is the second collection of systematic case studies describing national environmental policies in 17 countries in terms of capacity building (see Appen dix). The OECD defines environmental capacity building as "a society's ability to identify and solve environmental problems. " While various institutions, including UNEP, FAO, World Bank and OECD, have hitherto used the terms environmental capacity and capacity building almost exclusively with reference to developing countries, we have extended the concepts to industrialized countries, as well. The first collection, edited by Martin Janicke, Helge Joergens (both Free University Berlin) and Helmut Weidner (Social Science Research Center Berlin), was pub lished in 1997 under the title "National Environmental Policies - A Comparative Study of Capacity-Building" (Berlin, etc. : Springer Verlag). It included 13 studies of countries. As in the first volume, chapter I presents the conceptual framework underlying the national case studies. It is a slightly shorter version of the corresponding chap ter in volume I. The design of all case studies in the two volumes is largely con gruent with this conceptual framework. Although the various sections of the stud ies do not always have identical titles and subtitles, the central elements of the capacity-building approach have been applied in all cases.

The development of EU enlargement has raised many thorny issues unanticipated by the framers of the EC Treaty. A significant upshot of these issues is that the concept of European identity – defined in terms of such factors as culture, history and economics – has supplanted the long-dominant theme of ‘widening and deepening,’ particularly since the Union’s expansion has become primarily eastward. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the ‘identity’ conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between ‘widening’ and ‘deepening’ and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity. Also covered are specific historical details of particular pre-accession negotiations (e.g., Greece, Spain, Portugal, Malta, and Cyprus), the still inconclusive negotiations with Turkey and the Western Balkan states, and political factors involved in the non-accession of Norway, Iceland and Switzerland.
