Eine Welt ohne Kommentare? Für den deutschen Juristen ist das kaum denkbar. Die wichtigsten Gesetzeskommentare stehen auf dem Schreibtisch jedes Juristen, und in der Praxis wird das Recht weniger dem Gesetz als dem Kommentar entnommen. Auch für die europäischen Juristen des Mittelalters und der Frühen Neuzeit bestand die juristische Welt im Wesentlichen aus Kommentaren und Referenztexten. Gleichwohl ist bislang kaum untersucht, wie der Kommentar als Medium des juristischen Diskurses im Spannungsfeld zwischen Wissenschaft und Praxis wirkt und welche Strukturmerkmale und diskursive Funktionen als typisch für einen juristischen Kommentar gelten können. Im epochenübergreifenden historischen Vergleich analysiert David Kästle-Lamparter die »Kommentarlandschaft« verschiedener Wissenschaftskulturen und zeigt die Konstanten und Variablen der Kommentarliteratur in der Geschichte des Rechts auf. Auf dieser Grundlage werden Ansätze zu einer rechtstheoretischen Phänomenologie des juristischen Kommentars sichtbar. Die Arbeit wurde mit dem Ernst-Rabel-Preis 2014, dem Dissertationspreis der Westfälischen Wilhelms-Universität Münster 2015 und dem Johannes-Zilkens-Preis der Studienstiftung des deutschen Volkes 2016 ausgezeichnet. David Kästle-Lamparter examines the “world of commentaries” from a comparative historical perspective. He analyses how commentaries have become an essential medium of legal discourse in German and European jurisprudence and lays the foundation for a theory of juristic commentary.

This book presents a critical and empirically informed examination of Islamophobia and related issues of racism and nationalism in Germany today, with particular attention to the East/West distinction. The authors, representing several disciplines such as anthropology, sociology, and media and literary studies, situate the topic in the global and German context of the 2015-16 "migration crisis" and its aftermath, and of the ongoing transformations seen in the postsocialist regions of the European Union. Since the 2015-16 "refugee crisis," illiberal leaders and parties within Europe have instrumentalized Islamophobia in an attempt to dislodge the traditional political elites. Strikingly, such illiberal movements have been most successful in the formerly socialist areas of the EU. This is mirrored within Germany itself, where political formations with an Islamophobic agenda remain more popular in the East than in the West. This volume examines the reasons for this difference, including not only the ideological heritage of Soviet-dominated socialism but also the effects of western interventions in the formerly socialist areas in and beyond Germany since the end of the Cold War. Some Islamophobic and other hateful tendencies were in fact introduced from, and continue to prosper also, in the West. The chapters in this book were originally published as a special issue of the Journal of Contemporary European Studies.

Previous scholarship on recent Muslim Qurʾanic exegesis has mostly focussed on modernising trends, usually remaining within the confines of a single language area. Transcending this hitherto dominating narrow focus, this book offers a comparative analysis of a body of contemporary Sunnite Qurʾanic commentaries from the Arab World, Indonesia and Turkey. It takes into account both the influence of specific local conditions and the common intellectual heritage they rely on. By paying special attention not only to new developments, but also to the embeddedness of contemporary Qurʾanic exegesis into a more than thousand-year-old intellectual tradition, it provides new insights into the religious, academic, political and social context of exegetical practice in the modern Islamic World. Die Forschung zur neueren muslimischen Koranexegese hat sich bislang weitgehend auf modernisierende Trends konzentriert und sich dabei zumeist innerhalb der Grenzen eines Sprachraums bewegt. The frontiers of extraction are expanding rapidly, driven by a growing demand for minerals and metals that is often motivated by sustainability considerations. Two volumes of International Development Policy are dedicated to the paradoxes and futures of green extractivism, with analyses of experiences from five continents. In this, the second of the two volumes, the 22 authors, using different conceptual approaches and in different empirical contexts, demonstrate the alarming obduracy of the logic of extractivism, even - and perhaps especially - in the growing support for the so-called green transition. The authors highlight the complex and enduring legacies of resource extraction and the urgent need to move beyond extractive models of development towards alternative pathways that prioritise social justice, environmental sustainability, democratic governance and the well-being of both humans and non-humans. They also caution us against the assumption that anti-extraction is anti-extractivist, that post-extraction is post-extractivism, and they critically attune us to the systemic nature of extractivism in ways that both connect and transcend any particular site or scale. Soldier repatriation from Afghanistan has impacted debate about the war. This study highlights this impact with particular focus on Britain, Denmark and Germany. All three countries deployed soldiers soon after the 9/11 attacks, yet their role in Afghanistan and the casualty rates suffered, have been vastly different. This book looks at how their casualties influenced the framing of the war by analysing the political discourse about the casualties, how the media covered the repatriation and the burials, and how the dead were officially recognised and commemorated. Explaining how bodies count is not done exclusively by focusing on the political leadership and the media in the three countries, the response from the men and women in Afghanistan to the official framing of the war is given particular weight. Martinsen contributes to our understanding of European strategic culture by showing how countries respond to the same security challenges.
