Why are some subnational governments more likely to lobby the national government than others? Extant research in social sciences has widely discussed lobbying dynamics in the private sector. However, governments lobby governments, too. In the United States, lobbying is a popular strategy for state and local governments to obtain resources from and influence policies in the federal government. Nevertheless, extant research offers limited theoretical analysis or empirical evidence on this phenomenon. This Element provides a comprehensive study of intergovernmental lobbying activities in the United States and, in particular, an institutional analysis of the lobbying decisions of state and local governments. The study findings contribute to public administration, public policy, and political science literature by offering theoretical and empirical insights into the institutional factors that might influence subnational policymaking, fiscal resource management, intergovernmental relations, and democratic representation.

Lobbying can improve policy making by providing valuable insights and data, but it can also result in unfair advantages for vested interests if the process is opaque and standards are lax. Lobbying is resource intensive. The financial services sector in the United States spent USD 3.4 billion lobbying the federal government between 1998 and 2008, principally promoting the deregulation of the financial sector. Legions of lobbyists provide "guns for hire" worldwide. In 2008, there were over 5,000 registered lobbyists in Canada at the national level, while the European Commission in Brussels had over 2,000 registered as of August 2009. This report reviews the experiences of Australia, Canada, Hungary, Poland, the United Kingdom and the United States with government regulations designed to increase scrutiny for lobbying and lobbyists. Current approaches, models, trends and state-of-the-art solutions are examined to support a deeper understanding of the potential and limitations of existing norms. Why do firms lobby? This paper exploits the unanticipated sequestration of federal budget accounts in March 2013 that reduced the availability of government funds disbursed through procurement contracts to shed light on this question. Following this event, firms with little or no prior exposure to the federal accounts that experienced cuts reduced their lobbying spending. In contrast, firms with a high degree of exposure to the cuts maintained and even increased their lobbying spending. This suggests that, when the same number of contractors competed for a piece of a reduced pie, the more affected firms likely intensified their lobbying efforts to distinguish themselves from the others and improve their chances of procuring a larger share of the smaller overall. These findings are stronger in government-dependent sectors and when there is intense competition. The evidence is more consistent with a rent-seeking explanation for lobbying.

State and local governments emerged as important interest groups in the 1960s, as that decade witnessed a rapid expansion of federal social programs administered at the state and local levels. The 1970s and 1980s were distinguished by attempts to give states and localities more responsibility over such programs. The present day is marked by an even more purposeful return of responsibility and policymaking to state and local governments, both because of severe deficits at the federal level and an ideological shift toward federalism. This work examines the impact state and local governments have had and can have on the federal government, asserting that they can be important factors in the creation of policy. The author looks at the intergovernmental lobbying tactics—successful and unsuccessful—of five states and local lobbying groups: the National League of Cities, the U.S. Conference of Mayors, the National Association of Counties, the National Conference of State Legislatures, and the National Governor's Association. Her study will be of interest to scholars and policy-makers at the local, state, and federal government levels.
