Africa, with its mix of statute, custom and religion is at the centre of the debate about law and its impact on gender relations. This is because of the centrality of the gender question and its impact on the cultural relativism debate within human rights. It is therefore important to examine critically the role of law, broadly constructed, in African societies. The book focuses on women's experiences in the family. This is because the lives of women continue to be lived out largely in the private domain, where the right to privacy is used to conceal unequal treatment of women which is justified by invoking 'custom' and 'tradition'. The book shows how law and its interpretation is used to disenfranchise women, resulting in their being deprived of land and other property which they may have helped to accumulate. It also considers issues of violence within the home, reproductive rights and examines the issue of female genital cutting. The role of women in development is explored as is their participation in politics and the NGO sector. A major theme of the book is a consideration of the linkages of constitutional and international human rights norms with local values. This is done using feminist tools of analysis. The book considers the provisions of the Protocol to the African Charter on Human and People's Rights on the Rights of Women which was adopted by the African Union in July 2003.

This national gender profile describes South Africa's progress and challenges in achieving women's empowerment and gender equality goals. It measures the South African government's achievements against its stated commitments both within its supreme legislation - the Constitution, its policies, the legislative framework it has put in place, as well as the international agreements it is party to. The publication also assesses the impact of the institutional mechanisms for women's advancement that South Africa has put in place since 1994. The approach in gathering information has been comprehensive. The review is based on statistical data taken from the National Statistical Services to indicate major social trends. It also draws from government departments' reports of programmes implemented since 1994, the outcome of provincial and national "Conversations among Women", which took place between July and August 2003; and the Office on the Status of Women (OSW) Audits (1998, 2002, and 2003) of systems in place to enable gender mainstreaming. Information from South Africa's reports on the implementation of the Beijing Platform For Action (BPFA) as well as the SADC Declaration on Gender and Development was used in compiling this national gender profile.

Feminist lawyers have long been engaged in critiquing the gendered nature of South African law. This project has increased in importance and scope as a result of the centrality of gender equality, as a value and a substantive right, in the South African Constitution. Gender, Law and Justice provides both theoretical and practical tools to enable academic and practising lawyers to apply concepts of gender equality to the law. It introduces readers to basic feminist concepts and arguments, and to a wealth of local, comparative and international material on gender and the law. It also illustrates how the law may be shaped to transform the social, cultural and economic conditions of women's lives in South Africa, at the same time as it acknowledges the limits of legal strategies for change. This book has three main objectives. The first is to identify the different positions of women in South Africa and to examine the disparate impact of the legal system on their lives. Secondly, it aims to expose the gender bias in legal concepts and in the content and application of legal rules. Thirdly, it suggests changes to the law, and evaluates those changes that have already occurred, with a view to developing the law so that it is better able to ensure justice and meet the diverse needs of women in South Africa.
