Erstmals wird die Ausstrahlung Frankreichs, des "Mutterlandes der Revolution," auf das Deutschland im Revolutionsjahr 1848/49 in allen Aspekten erforscht. Im Zentrum stehen das sich in der offentlichen Diskussion manifestierende Frankreichbild und seine Auswirkungen auf das politische Handeln. Zunachst wird Frankreich als auaen- und machtpolitischer Faktor beleuchtet, sodann seine Rolle als verfassungs- und gesellschaftspolitisches Leitbild und schliealich als Trager und Quelle der revolutionaren Idee analysiert. Ein Vergleich des frankreichfernen Preuaen mit dem grenznahen deutschen Suedwesten macht regionale Unterschiede sichtbar. Die Basis bildet ein in diesem Umfang noch nie erschlossenes Quellenmaterial, darunter Zeitungen, Flugblatter, Parlamentsdebatten und bildliche Darstellungen. Stereotype im deutsch-franzosischen Verhaltnis werden kritisch hinterfragt, so z. B. die These, die deutsche Nationalidee habe sich einzig aus dem Feindbild Frankreich genahrt. Diese anschauliche Studie fuehrt mit subtilem Gespuer fuer die Quellen zu einem modifizierten und verfeinerten Verstandnis der deutschen Revolution von 1848/49. This book aims to study the departure and reception of refugees in 19th-century Europe, from the Congress of Vienna to the 1870-1880s. Through eight chapters, it draws on a transnational approach to analyze migratory movements across European borders. The book reviews the chronology of exile and shows how European states welcomed, selected, and expelled refugees. In addition to presenting the point of view of nation-states, it reflects the experience of those migrating. The book addresses departure into exile, captured through the material circumstances of crossing borders in the 19th century, and examines the emergence of new ways to pursue political commitments from abroad. The outcasts are considered in all their diversity, with a prominent place accorded to women and children, many of whom also moved under duress. The book aims to shed light on the forced migrations of Europeans across Europe, while also considering the global dimension, looking at exile to the Americas or the French colonies. A final chapter examines the impossibility or difficulty of returning from exile to one’s country of origin, as well as the a posteriori memorial constructs around that crucial experience.

Seit dem ausgehenden 18. Jahrhundert verband sich die Freiheitssymbolik mit demokratischer Ordnung sowie mit dem Schutz von Menschenrechten. Mit ihrer grenzüberschreitenden visuellen Omnipräsenz beförderte sie die Akzeptanz des westlichen Verfassungsstaates und das freiheitliche politische Bewusstsein der westlichen Welt. Rainer Schmidt entwickelt Elemente einer politischen Theorie der Verfassung anhand der zentralen Kategorien von Verfassungskultur und Verfassungssoziologie, um mit ihnen die Spannung zwischen Recht und Politik zu analysieren, in der sich die Verfassung im 19. Jahrhundert in Deutschland bewegt. Ausgehend von Kant, Pölitz und Hegel finden im Deutschland des 19. Jahrhunderts grundlegende Reflexionen über das Zusammenspiel von Recht, Macht und Verfassung statt, in denen noch die Fülle eines politischen Konstitutionalismus zum Ausdruck kommt. In der prägenden Phase des Rechtspositivismus geraten die wichtigen politischen und sozialen Kontexte der Verfassung in Vergessenheit, um im Vorfeld der Weimarer Reichsverfassung wieder aufgegriffen zu werden. Damit ist das Feld zwischen einem rein rechtlichen und einem umfassenderen politischen Konstitutionalismus in Deutschland im 19. Jahrhundert abgesteckt. Der Autor zeigt, dass die Anreicherung des Verfassungsverständnisses um kulturwissenschaftliche Elemente der symbolischen Dimension von politischen Ordnungen es ermöglicht, den komplexen Geltungszusammenhang von Verfassungen zu erfassen.
