Critical Race Theory (CRT) is virtually unheard of in European scholarship, especially among legal scholars. Law, Lawyers and Race: Critical Race Theory from the United States to Europe endeavours to fill this gap by providing an overview of the definition and consequences of CRT developed in American scholarship and describing its transplantation and application in the continental European context. The CRT approach adopted in this book illustrates the reasons why the relationship between race and law in European civil law jurisdictions is far from anodyne. Law plays a critical role in the construction, subordination and discrimination against racial minorities in Europe, making it comparable, albeit in slightly different ways, to the American experience of racial discrimination. Anti-Semitism, Islamophobia, anti-Roma and anti-Black racism constitute a fundamental factor, often tacitly accepted, in the relationship between law and race in Europe. Consequently, the broadly shared anti-race and anti-racist position is problematic because it acts to the detriment of victims of racism while privileging the White, Christian, male majority. This book is an original exploration of the relationship between law and race. As such it crosses the disciplinary divide, furthering both legal scholarship and research in Race and Ethnicity Studies.

This volume looks at territories such as reservations, model villages and collective towns as the spatial materialization of forced assimilation and "progress". These disciplinary spaces were created in order to disempower and alter radically the behavior of people who were perceived as ill-suited "to fit" into hegemonic imaginations of "the nation" since the 19th century. Comparing examples from the Americas, Australia, North and East Africa, Central Europe as well as West and Central Asia, the book not only considers the acts and legitimizing narrations of ruling actors, but highlights the agency of the subaltern who are often misrepresented as passive victims of violent assimilation strategies.

This thesis highlights the importance of analyzing the genocide of the Sinti and Roma by investigating the memoirs of Sinti and Roma. To do so, it analyzes several memoirs: Otto Rosenbergs, Zoni Weisz, Hugo Höllenreiners, Zilli Schmidts, Florian Reinhards and lastly, the memoir in which the fates of three families, the Mettbachs, Höllenreiners, and Schönberger are discussed. Why those memoirs were chosen and how much those survivors contribute to the memory of the Sinti and Roma persecution are further elaborated in this thesis. The goal of this work is to recover the fate of the Sinti and Roma in its own right, as seen through the memories of some of the victims, without creating a hierarchy of the suffering of the different victims of the Second World War. Many researchers already concentrate their topics around a comparison between the Sinti and Roma and Jewish persecutions. In a certain sense, it is even sometimes inevitable to not compare them, especially because the Sinti and Roma talk about the Jewish and other victims in their memoirs. The genocide of the Sinti and Roma is nowadays well documented, yet it is still interesting to combine the two aspects, which will be the legal political facts and the personal experiences, feelings, and thoughts. Furthermore, it examines the development of their postwar memory since, for decades, they were the forgotten victims of World War Two. So, following research questions are answered: 1. What light can egodocuments shed on lived experiences during the Second World War? 2. What role did egodocuments play in the post-war construction of the memory of the Sinti and Roma genocide? So, the goal is to show what those memoirs add to the scholarly debate. Egodocuments are therefore at the center of this whole thesis, to establish a chronological structure of the war but also its aftermath.
