Inhaltsangabe:Einleitung: Das vom Europäischen Gerichtshof (EuGH) anhand eines deutschen Rechtsstreits gefällte Urteil vom 9. September 2003 zur vollständigen Einordnung des Bereitschaftsdienstes als Arbeitszeit unterstreicht eine sich bereits länger abzeichnende Entwicklung. Nach dem SIMAP-Urteil vom 3. Oktober 2000 war der EuGH wiederholt gezwungen, sich zu der arbeitszeitschutzrechtlichen Bewertung des Bereitschaftsdienstes zu äußern. Damals entschied der EuGH, zugunsten spanischer Ärzte, den Bereitschaftsdienst vollständig als Arbeitszeit anzuerkennen. Mit dem nun vorliegenden Urteil bestätigte der EuGH seine Stellung und wies das Landesarbeitsgericht Schleswig-Holstein an, dem Begehren eines deutschen Arztes in einer vergleichbaren Angelegenheit ebenso stattzugeben. Es dauerte also fast drei Jahre, bis der EuGH der Diskussion in Deutschland über die Einordnung des Bereitschaftsdienstes ein Ende setzte und die unterschiedlichen Rechtsprechungen „auf einen Nenner“ brachte. Das in Deutschland seit mehreren Jahrzehnten gewachsene arbeitszeitrechtliche Verständnis wurde damit erschüttert. Die Brisanz der Interpretation des EuGH ergibt sich aus der Schwere und der noch nicht endgültig absehbaren Reichweite der Konsequenzen. Die notwendige und überfällige Anpassung des deutschen Arbeitszeitgesetzes konkretisiert damit die bereits aus wettbewerblicher und betriebsinterner Sicht entstandene Verpflichtung zugunsten kürzerer, neu geordneter Arbeitszeiten. Der Handlungsdruck in den Krankenhäusern in Bezug auf die ärztliche Arbeitszeitgestaltung verschärft sich ferner aus zwei weiteren Gründen: Einerseits erwächst innerhalb der Ärzteschaft mehr und mehr die Forderung nach neuzeitlichen Arbeitszeitstrukturen. Die bisher an den Krankenhäusern vorbeigegangene Professionalisierung betrieblicher Arbeitszeitgestaltung mit den damit verbundenen Flexibilisierungs- und Effizienzpotentialen erschwert die Identifizierung der Ärzte mit der Arbeitssituation. Aufgrund der knappen Zahl hoch qualifizierter Ärzte auf dem Arbeitsmarkt erstarkt die Forderung nach akzeptablen Arbeits(zeit)bedingungen. Diese Kritik scheint berechtigt, denn ungünstige Arbeitszeitregelungen mindern nicht nur die Attraktivität des ärztlichen Berufes, sondern können überdies gesundheitliche Beschwerden begründen. Die Möglichkeit, unter Zuhilfenahme arbeitswissenschaftlicher Erkenntnisse, den Gesundheitsschutz der Ärzteschaft zu stärken, ist dabei der Neuorganisation der ärztlichen Arbeitszeit [...]

Die verbesserte Erstversorgung am Notfallort durch das neue Berufsbild der Notfallsanitäterinnen und -sanitäter korrespondiert mit den Bemühungen um eine immer weiter steigende Qualität der Versorgung, die auch durch die gesetzliche Fixierung der Ärztlichen Leitung Rettungsdienst Akzente erfahren hat. Die Ausbildungsfinanzierung des neuen Berufs wurde geregelt. Mit dem Kommentar sind insbesondere die Kommunalen Aufgabenträger, die freiwilligen Hilfsorganisationen, Krankentransportunternehmen sowie die Berufsgruppen der Notfallsanitäterinnen und -sanitäter, der Rettungsassistentinnen und -assistenten, der Rettungssanitäterinnen und -sanitäter, der Krankenhäuser sowie die ärztlichen Beschäftigten in notärztlicher Tätigkeit angesprochen."

What are the underlying rationales for industrial policy? Does empirical evidence support the use of industrial policy for correcting market failures that plague the process of industrialization? To address these questions, the authors provide a critical survey of the analytical literature on industrial policy. They also review some recent industry successes and argue that only a limited role was played by public interventions.
