Em maio de 1831, Alexis de Tocqueville foi enviado aos Estados Unidos pelo governo francês para estudar o sistema prisional americano. Seu relatório foi apresentado após nove meses de viagem, mas foram suas demais anotações sobre economia e política que resultaram nesta obra, publicada originalmente em dois volumes.
