When do social movements take off? Sexual harassment was once something that women had to endure; now a movement has risen up against it. White nationalist sentiments, on the other hand, were largely kept out of mainstream discourse; now there is no shortage of media outlets for them. In this book, with the help of behavioral economics, psychology, and other fields, Cass Sunstein casts a bright new light on how change happens. Sunstein focuses on the crucial role of social norms—and on their frequent collapse. When norms lead people to silence themselves, even an unpopular status quo can persist. Then one day, someone challenges the norm—a child who exclaims that the emperor has no clothes; a woman who says “me too.” Sometimes suppressed outrage is unleashed, and long-standing practices fall. Sometimes change is more gradual, as “nudges” help produce new and different decisions—apps that count calories; texted reminders of deadlines; automatic enrollment in green energy or pension plans. Sunstein explores what kinds of nudges are effective and shows why nudges sometimes give way to bans and mandates. Finally, he considers social divisions, social cascades, and “partyism,” when identification with a political party creates a strong bias against all members of an opposing party—which can both fuel and block social change.

O processo de aquisições públicas sustentáveis constitui instrumentos relevantes de contribuição para a sustentabilidade, pois a utilização de recursos públicos pelo Estado em suas contratações gera consequências positivas, como o aumento na oferta de empregos e a competitividade entre as empresas. O presente trabalho teve por objetivo avaliar a existência de práticas de sustentabilidade nas contratações de produtos e serviços pelo Poder Judiciário do Estado da Bahia, através de uma análise sobre o poder de compra estatal, a compreensão da responsabilidade socioambiental e a missão da Administração Pública de conciliar o crescimento econômico com a proteção ambiental, com ênfase ao destaque concedido à preservação do meio ambiente sadio e ecologicamente equilibrado como direito fundamental, conforme o artigo 225 da Constituição Federal. Fez-se um levantamento sobre exemplos de boas práticas de governança realizadas pelo Poder Judiciário da Bahia em relação à Agenda 2030 da ONU para Desenvolvimento Sustentável, com os 17 Objetivos de Desenvolvimento Sustentável (ODS), por meio de abordagem qualitativa na qual se utiliza a base de dados disponibilizada pelo Tribunal de Justiça da Bahia em seu sítio eletrônico. Concluiu-se que, devido ao seu poder de compra e forte instrumento de atuação e intervenção na ordem econômica, a Administração Pública deve priorizar realizar contratações sustentáveis e observar em suas aquisições, além dos aspectos ambientais, os aspectos sociais.

This book provides a fascinating analysis of a single jurisdiction, Brazil, and accounts for both the successes and the failures of its most recent constitutional project, inaugurated by the Constitution of 1988. It sets out the following aspects of the constitutional development and erosion: - the different phases of the promised transition from military rule to a 'social-democratic constitutionalism'; - the obstacles to democratisation derived from the absence of true institutional reforms in the judicial branch and in the civil-military relationship; - the legal and social practices which maintained a structure that obstructed the emergence of an effective social-democracy, such as the neoliberal pattern, the acceptance in the political field of unlawful organisations, such as the milícias, and the way the digital revolution has been harming the formation of democratic sovereignty. Situating Brazil in the global context of the revival of authoritarianism, it details the factors which are common to the third wave of democratisation reflux. Accounting for those aspects, particular to the Brazilian jurisdiction, it shows that there is a tension in the Brazilian constitution. On the one hand, such constitutionalism was renewed by democratic pressure on governments to undertake social politics since 1988. On the other hand, it retained authoritarian practices through the hands of diverse institutions and political actors. By exploring the ideas of constitutional erosion and collapse, as well as democratic, social and digital constitutionalism, the book presents a comparative analysis of Brazil and other jurisdictions, including the United States, South Africa, and Peru.
