Entre as teorias desenvolvidas em torno da temática da justiça, a teoria do filósofo norte-americano John Rawls se apresenta como um marco na Filosofia Política anglo-americana. Seu pensamento político oferece referenciais que conduzem a diferentes análises orientadas à compreensão do Estado Constitucional Democrático e da dimensão político-institucional da justiça. Dentre estes referenciais situa-se a ideia de 'razão pública', a qual leva à noção do estabelecimento de um consenso sobre os valores políticos e as bases de justificação da atuação política. São a ideia de razão pública e seu princípio liberal de legitimidade que oferecem as bases de reflexão rawlsiana acerca da legitimidade democrática da atuação legislativa. Observa-se, contudo, haver proposições teóricas que conduzem a análise da legitimidade das instituições representativas a partir de uma orientação distinta, que considera inalcançável o estabelecimento de um consenso representativo do qual deva depender a realização da legitimidade da atuação das instituições de um Estado, especialmente da atuação de um corpo legislativo. Esta é a orientação de autores como Jeremy Waldron e Samantha Besson, para os quais a tarefa de alcançar a justiça política não pode ser a de encontrar uma teoria principal que dissolva o desacordo, como entendem pretender a proposta de Rawls embasada na ideia de razão pública, uma vez que seria o próprio desacordo o verdadeiro elemento legitimador da atividade política. É frente às reflexões dos autores destacados que se buscou, através do presente estudo, relacionar as proposições teóricas que envolvem a temática da legitimidade da atuação legislativa a partir da 'dicotomia consenso e desacordo'. Investiga-se diante desta abordagem a medida da ideia rawlsiana de razão pública como referencial para a aferição da legitimidade da atuação legislativa.

What is to be understood by 'rational legal argument'? To what extent can legal reasoning be rational? Is the demand for rationality in legal affairs justified? What are the grand dynamics that drive the accumulation and distribution of capital? Questions about the long-term evolution of inequality, the concentration of wealth, and the prospects for economic growth lie at the heart of political economy. But satisfactory answers have been hard to find for lack of adequate data and clear guiding theories. In this work the author analyzes a unique collection of data from twenty countries, ranging as far back as the eighteenth century, to uncover key economic and social patterns. His findings transform debate and set the agenda for the next generation of thought about wealth and inequality. He shows that modern economic growth and the diffusion of knowledge have allowed us to avoid inequalities on the apocalyptic scale predicted by Karl Marx. But we have not modified the deep structures of capital and inequality as much as we thought in the optimistic decades following World War II. The main driver of inequality--the tendency of returns on capital to exceed the rate of economic growth--today threatens to generate extreme inequalities that stir discontent and undermine democratic values if political action is not taken. But economic trends are not acts of God. Political action has curbed dangerous inequalities in the past, the author says, and may do so again. This original work reorients our understanding of economic history and confronts us with sobering lessons for today.

From recent data on disparities between Brazilian whites and non-whites in areas of health, education, and welfare, it is clear that vast racial inequalities do exist in Brazil, contrary to earlier assertions in race relations scholarship that the country is a "racial democracy." Here Michael George Hanchard explores the implications of this increasingly evident racial inequality, highlighting Afro-Brazilian attempts at mobilizing for civil rights and the powerful efforts of white elites to neutralize such attempts. Within a neo-Gramscian framework, Hanchard shows how racial hegemony in Brazil has hampered ethnic and racial identification among non-whites by simultaneously promoting racial discrimination and false premises of racial equality. Drawing from personal archives of and interviews with participants in the Movimento Negro of Rio de Janeiro and Sao Paulo, Hanchard presents a wealth of empirical evidence about Afro-Brazilian militants, comparing their effectiveness with their counterparts in sub-Saharan Africa, the United States, and the Caribbean in the post-World War II period. He analyzes, in comprehensive detail, the extreme difficulties experienced by Afro-Brazilian activists in identifying and redressing racially specific patterns of violation and discrimination. Hanchard argues that the Afro-American struggle to subvert dominant cultural forms and practices carries the danger of being subsumed by the contradictions that these dominant forms produce.
