Na generalidade dos casos em que a dignidade vem invocada como princípio jurídico temos enorme dificuldade em precisar o seu conteúdo normativo e, especialmente, em determinar quando o princípio constitucional da dignidade da pessoa humana está ou não a ser violado. O que para uns é uma ofensa à dignidade, para outros é uma exigência do respeito de uma vida digna. Sem prejuízo do direito que cada um tem, numa sociedade aberta e plural, de viver de acordo com as suas concepções e escolhas, interessa-nos, neste plano, saber quando pode o Estado de Direito impor, permitir ou proibir determinado comportamento em nome da dignidade da pessoa humana. Mais precisamente, interessa-nos, a partir do momento em que a dignidade é constitucionalmente reconhecida e consagrada como base em que assenta a República, saber quando há inconstitucionalidade por eventual violação do princípio constitucional da dignidade da pessoa humana e como se deve fundamentar a correspondente decisão de inconstitucionalidade. É esse o tema deste segundo volume dedicado à dignidade da pessoa humana em Estado de Direito.

Este é o primeiro de um conjunto de quatro volumes sobre a dignidade da pessoa humana de que já foi também publicado o segundo (Dignidade e Inconstitucionalidade). Em paralelo, foi igualmente publicada uma obra colectiva sobre a Dignidade da Pessoa Humana na Justiça Constitucional. Aborda-se neste primeiro volume, para além da história do conceito e do sentido da recepção constitucional do princípio da dignidade da pessoa humana, a relação complexa entre dignidade e direitos fundamentais. Aí se consideram as diferentes modalidades de utilização do princípio e que vão desde a simples identificação da dignidade com os direitos fundamentais, a utilização da dignidade a favor ou ao lado dos direitos fundamentais e, por último, a invocação jurídica do princípio da dignidade contra os direitos fundamentais. Relacionada com esta última modalidade, desenvolve-se especialmente a crítica à mobilização abusiva da dignidade humana contra a liberdade, a autonomia e o bem-estar individuais.
