This book returns to the historical moment of the creation of the penitentiary in industrializing England in the late eighteenth and early nineteenth centuries. The book documents the rise of a new conception of class relations and a new philosophy of punishment. Both were directed at the mind rather than the body, wherein the whip, the brand and the gallows were being replaced by the prison. The ways in which the middle and upper classes tried to forge new methods for controlling the poor and the ways the poor and imprisoned resisted those controls are examined. The author raises questions about the manner in which reform can be used to consolidate the power of the state and about the moral boundaries of authority.

Isaiah Berlin (1909-97) was recognized as Britain's most distinguished historian of ideas. Many of his essays discussed thinkers of what this book calls the 'long Enlightenment' (from Vico in the eighteenth century to Marx and Mill in the nineteenth, with Machiavelli as a precursor). Yet he is particularly associated with the concept of the 'Counter-Enlightenment', comprising those thinkers (Herder, Hamann, and even Kant) who in Berlin's view reacted against the Enlightenment's naïve rationalism, scientism and progressivism, its assumption that human beings were basically homogeneous and could be rendered happy by the remorseless application of scientific reason. Berlin's 'Counter-Enlightenment' has received critical attention, but no-one has yet analysed the understanding of the Enlightenment on which it rests. Isaiah Berlin and the Enlightenment explores the development of Berlin's conception of the Enlightenment, noting its curious narrowness, its ambivalence, and its indebtedness to a specific German intellectual tradition. Contributors to the book examine his comments on individual writers, showing how they were inflected by his questionable assumptions, and arguing that some of the writers he assigned to the 'Counter-Enlightenment' have closer affinities to the Enlightenment than he recognized. Investigating the cultural, social, and political histories of punishment during ninety years surrounding the 1838 abolition of slavery in Jamaica, Diana Paton challenges standard historiographies of slavery and discipline. The abolition of slavery in Jamaica, as elsewhere, entailed the termination of slaveholders’ legal right to use violence—which they defined as “punishment”—against those they had held as slaves. Paton argues that, while slave emancipation involved major changes in the organization and representation of punishment, there was no straightforward transition from corporal punishment to the prison or from privately inflicted to state-controlled punishment. Contesting the dichotomous understanding of pre-modern and modern modes of power that currently dominates the historiography of punishment, she offers critical readings of influential theories of power and resistance, including those of Michel Foucault, Pierre Bourdieu, and Ranajit Guha. No Bond but the Law reveals the longstanding and intimate relationship between state formation and private punishment. The construction of a dense, state-organized system of prisons began not with emancipation but at the peak of slave-based wealth in Jamaica, in the 1780s. Jamaica provided the paradigmatic case for British observers imagining and evaluating the emancipation process. Paton’s analysis moves between imperial processes on the one hand and Jamaican specificities on the other, within a framework comparing developments regarding punishment in Jamaica with those in the U.S. South and elsewhere. Emphasizing the gendered nature of penal policy and practice throughout the emancipation period, Paton is attentive to the ways in which the actions of ordinary Jamaicans and, in particular, of women prisoners, shaped state decisions.

What was the role of elected legislators? Was it to represent the opinions of constituents or to vote according to their informed opinions reflecting the needs of the kingdom? Most authorities have accepted Edmund Burke's depiction of 18th-century MPs, insisting it was their right to form their opinions without reference to the instructions of constituents. This study provides answers to these important questions and, in doing so, reveals that Burke's vision does not represent how the House of Commons functioned during the last two decades of the 18th century. Rather than focusing on specific issues or demographic groups, English MPs brings to the fore the legislative activity of a broad segment of late 18th-century English MPs. This book shows they were diligent legislators who attended to the needs of constituents, in the process developing strong connections with them. It demonstrates that these connections did not rest on shared beliefs in reformist ideologies except in, and around, the metropolis. Instead, they grew out of the members' timely and effective tending, session after session, to the host of measures brought forward by constituents and neighbours. McCahill explores, in fascinating detail, the consequences of this bond. In this book, McCahill draws from an impressive array of primary sources and secondary literature to combine a structural analysis with broad surveys and detailed case-studies.
