O livro estabelece uma reflexão sobre o problema da barreira atitudinal da linguagem jurídica, na questão da acessibilidade, com relação ao acesso à Justiça, acesso ao Direito e acesso à informação. Há vários obstáculos que comprometem a capacidade de efetividade do direito. Nesse sentido, o vocábulo jurídico hermético pode se enquadrar como uma ferramenta de tolhimento e de cerceamento do amplo acesso à Justiça. A concretização da facilitação do acesso à informação por meio da simplificação da linguagem passa a exigir do jurista um atributo, pois além da compreensão e do domínio da linguagem e de seus tecnicismos, é necessária a capacidade de tradução, ou de facilitação, e de transformação desse conteúdo em comunicação com linguagem direta e clara, que possibilite o reconhecimento, por exemplo, de uma situação de violação de seus direitos básicos. Dessa forma, o objetivo da obra é estimular reflexões acerca da importância da linguagem jurídica acessível e inteligível entre os protagonistas sociais, vocábulos que massificam e democratizam o conhecimento do Direito e estabelecem uma relação entre o cidadão e as estruturas e mecanismos de atuação da Justiça. Para isso, faz-se necessário identificar os ruídos, defeitos e falhas na comunicação da linguagem jurídica e quais os meios para sanar o problema da inacessibilidade, trazendo, ainda, a possibilidade de aliar a linguagem do Direito às ferramentas do Design Jurídico e Direito Visual, utilizando a tecnologia e novas metodologias a favor da prestação jurisdicional, e de modo a entender, também, quais os posicionamentos acerca do referido tema, casos práticos, soluções inovadoras e formas de criar novos modelos e de redesenhar os serviços judiciais.

A landmark in the development of modern jurisprudence, the pure theory of law defines law as a system of coercive norms created by the state that rests on the validity of a generally accepted Grundnorm, or basic norm, such as the supremacy of the Constitution. Entirely self-supporting, it rejects any concept derived from metaphysics, politics, ethics, sociology, or the natural sciences. Beginning with the medieval reception of Roman law, traditional jurisprudence has maintained a dual system of "subjective" law (the rights of a person) and "objective" law (the system of norms). Throughout history this dualism has been a useful tool for putting the law in the service of politics, especially by rulers or dominant political parties. The pure theory of law destroys this dualism by replacing it with a unitary system of objective positive law that is insulated from political manipulation. Possibly the most influential jurisprudent of the twentieth century, Hans Kelsen [1881-1973] was legal adviser to Austria's last emperor and its first republican government, the founder and permanent advisor of the Supreme Constitutional Court of Austria, and the author of Austria's Constitution, which was enacted in 1920, abolished during the Anschluss, and restored in 1945. The author of more than forty books on law and legal philosophy, he is best known for this work and General Theory of Law and State. Also active as a teacher in Europe and the United States, he was Dean of the Law Faculty of the University of Vienna and taught at the universities of Cologne and Prague, the Institute of International Studies in Geneva, Harvard, Wellesley, the University of California at Berkeley, and the Naval War College. In his 1996 State of the Union Address, President Bill Clinton announced that the "age of big government is over." Some Republicans accused him of cynically appropriating their themes, while many Democrats thought he was betraying the principles of the New Deal and the Great Society. Mark Tushnet argues that Clinton was stating an observed fact: the emergence of a new constitutional order in which the aspiration to achieve justice directly through law has been substantially chastened. Tushnet argues that the constitutional arrangements that prevailed in the United States from the 1930s to the 1990s have ended. We are now in a new constitutional order--one characterized by divided government, ideologically organized parties, and subdued constitutional ambition. Contrary to arguments that describe a threatened return to a pre-New Deal constitutional order, however, this book presents evidence that our current regime's animating principle is not the old belief that government cannot solve any problems but rather that government cannot solve any more problems. Tushnet examines the institutional arrangements that support the new constitutional order as well as Supreme Court decisions that reflect it. He also considers recent developments in constitutional scholarship, focusing on the idea of minimalism as appropriate to a regime with chastened ambitions. Tushnet discusses what we know so far about the impact of globalization on domestic constitutional law, particularly in the areas of international human rights and federalism. He concludes with predictions about the type of regulation we can expect from the new order. This is a major new analysis of the constitutional arrangements in the United States.
