With the world watching closely, Myanmar began a process of political, administrative and institutional transition from 30 January 2011. After convening the parliament, elected in November 2010, the former military regime transferred power to a new government headed by former Prime Minister (and retired general), U Thein Sein. With parliamentary processes restored in Myanmar's new capital of Naypyitaw, Thein Sein's government announced a wide-ranging reform agenda, and began releasing political prisoners and easing press censorship. Pivotal meetings between Thein Sein and Aung San Suu Kyi led to amendment of the Election Law and the National League for Democracy contesting by-elections in April 2012. The 2011 Myanmar/Burma update conference considered the openings offered by these political changes and media reforms and the potential opportunities for international assistance. Obstacles covered include impediments to the rule of law, the continuation of human rights abuses, the impunity of the Army, and the failure to end ethnic insurgency.

This is an attempt to study and interpret the Constitution of the Union of Burma which has now passed its tenth year. A constitution read outside the context of constitutional history is incomplete, and I have, therefore, tried to trace the developments which culminated in the constitution; then study its important features with reference, where necessary, to the background in which they took shape and form; and, while studying how the constitution has been working, touch lightly on contemporary events and trends. It is a vast canvas I am trying to cover and what I am able to draw on it would inevitably be sketchy. But I do not write as a historian whose focus is on detail in a narrow area. Rather, having dug and gathered the facts, I trace their sweep in history. The details I willingly and happily leave to the historians, hoping only that my study will be of some use to them, if only as a target for their learned criticism. Some of the events and people I describe are still too near, and a clear perspective is therefore difficult. What is nearest appears biggest, and I often find it tempting to see and accept that Burma's history as a new independent nation began with the students' strike of 1936 or the resistance movement during the Second World War.

Myanmar's Constitution of 2008 was the 'road map' for the reform process that began in 2011. Burma faces a complex of interlinked humanitarian, social, and political crises. The situation is especially grave in areas populated by ethnic minorities, many of which have been affected by decades of armed conflict, and in the Irrawaddy Delta, where in May 2008 some 130,000 people were killed and over two million made homeless by Cyclone Nargis. The military government is deeply unpopular, and further episodes of mass protest similar to those that occurred in August and September 2007 cannot be ruled out. However, strategic options for elite-level regime change in the country remain limited. Therefore, local and international actors should focus on incremental approaches to democratization, and in particular on the roles of local communities and NGOs. The past decade has seen an expansion of previously dormant civil society networks, especially within and between ethnic nationality communities. This development has been particularly significant in areas affected by ceasefires between armed ethnic groups and the military government. The capacities and strategic importance of local NGOs were demonstrated by the impressive civil society responses to the cyclone. At the local level, models of community participation and the promotion of democracy from below can help to transform state-society relations and patterns of governance, including in ceasefire areas. At the national/elite level, the development of civil society is a prerequisite for sustainable democratic change. Although the promotion of civil society is necessary, it is not sufficient to achieve social and political transition in Burma. Furthermore, community networks are vulnerable to suppression by the militarized state and by armed nonstate actors. Such tendencies were demonstrated during the national referendum of May 2008, when the government engineered the endorsement of a new constitution designed to consolidate and perpetuate military rule. The challenge for the international community is to work within the constricted environment of military-ruled Burma in ways that promote positive change - but without exposing local partners to unacceptable risks.

Myanmar has faced numerous divisions that hinder its democratization and peacebuilding processes since emerging out of decades of military dictatorship. The coup d’état in 2021 terminated Myanmar’s limited and nascent democratization under the civilian leadership of the National League for Democracy (NLD); not only did the coup regime resurface old struggles, but also created new ones. Against the backdrop of Myanmar’s changing political landscapes from military to quasi-civilian to civilian rule in 2016, and back to military rule in 2021, the book discusses the various forms of interconnected struggles, both old and new. In this process, the contributed chapters come together to highlight the changing dynamics of stakeholders, relations between agents and beneficiaries, and the generated evolutionary processes in Myanmar’s democratization and its reversal.
