Enquanto veículo de construção e transmissão da ideia, a linguagem desde sempre exerceu sobre o homem um profundo e fértil fascínio. Um fascínio que explica, em parte, a verdadeira explosão de indagações e análises hermenêuticas a que o último século assistiu, nos mais diversos domínios do conhecimento. A recepção crítica destes trabalhos pela teoria e pela prática jurídicas, horizonte temático em que este estudo se inscreve, tem vindo a ser sistematicamente empreendida pela jurisprudência anglo-saxónica, onde os estudos interdisciplinares se têm fecundamente desenvolvido em torno da associação do Direito com a Literatura, a Retórica e a Hermenêutica em particular, e com as Humanidades em geral. Reclamando embora a natureza linguística, retórico-argumentativa e hermenêutica de uma parte considerável da realidade jurídica, e sublinhando a quase omnipresença da mediação interpretativa na actividade cognoscitiva em geral, este estudo pretende, ainda assim, mostrar em que medida a específica vocação normativa do Direito norteia os sentidos com que o mesmo, dia após dia, se constrói. Essa será precisamente a medida da fortuna de estudos que, não rejeitando, antes procurando robustecer, afinidades entre textualidades e narrativas judiciárias e literárias, hermenêutica jurídica e literária, contribuirão para a fundamental formação técnica e humana de todo o jurista. Perspective determines how we, as viewers, perceive painting. We can convince ourselves that a painting of a bowl of fruit or a man in a room appears to be real by the way these objects are rendered. Likewise, the trick of perspective can prevent us from being absorbed in a scene. Connecting contemporary critical theory with close readings of seventeenth-century Dutch visual culture, The Rhetoric of Perspective puts forth the claim that painting is a form of thinking and that perspective functions as the language of the image. The cruel power of misdirected words, artfully structured but spiritually empty and bearing the stamp of law or legalistic reasoning, is a persistent theme in the modern novel. Richard Weisberg, who has written extensively on both literature and law, explores the role of legalism and its abuses in eight major novels of the nineteenth and twentieth centuries. Beginning with Dostoevski and moving by way of trenchant analyses of Flaubert and Camus, Weisberg culminates his argument in a brilliantly revisionist reading of Melville's Billy Budd. In each of the novels treated, Weisberg sees a verbally gifted central character relying on wordiness to avoid or distort previously revealed truths. He argues that the malaise Nietzsche called ressentiment goads these characters to verbalizations that do violence to others and, ironically, indict their very creators. He identifies the legalistic theme as the major mode of iconoclasm in modern fiction and the source of its holocaustic vision. Writers, he reflects, viewed with profound skepticism their culture's tendency to substitute complex narrative formalism for earlier, absolute approaches to justice.
