O presente livro faz um panorama do histórico do setor elétrico brasileiro, dos diferentes regimes jurídicos aplicáveis e da teoria tradicional dos contratos administrativos, abordando como a correta aplicação do princípio da proteção à confiança milita em favor da previsão de regras de transição razoáveis ou de indenizações, que de alguma forma suavizem a frustração da confiança dos particulares. Ademais, a obra é um convite à institucionalização da proteção à confiança no setor elétrico, para se evite ao máximo a frustração de expectativas, o fracasso de empreendimentos privados e a deterioração dos serviços.

As modificações na jurisprudência estão presentes nos países de common law e de civil law, pois decorrem da necessidade de evolução na compreensão do direito pelo Poder Judiciário, a fim de acompanhar as mudanças na sociedade. Não obstante, uma vez que o Poder Judiciário exerce importante papel na definição de pautas de conduta para a sociedade, nas quais agentes públicos e privados se baseiam para conduzir suas atividades, as modificações na jurisprudência têm o potencial de frustrar a confiança depositada pelos jurisdicionados na estabilidade de entendimentos consolidados. Desta forma, é necessário alcançar um equilíbrio entre a necessidade de evolução da jurisprudência, de um lado, e a proteção das expectativas legítimas originadas da consolidação de entendimentos no Judiciário, de outro, por meio do princípio da proteção da confiança. Esta obra busca apresentar uma proposta de sistematização dos atos jurisdicionais como base da confiança no direito brasileiro, de forma a conferir parâmetros seguros para a incidência do princípio nas modificações na jurisprudência. Além disso, a partir da análise do tema no direito estrangeiro, bem como no direito positivo e na jurisprudência nacionais, objetiva-se formular propostas de interpretação do direito vigente no Brasil, de modo a dele extrair uma máxima proteção às expectativas legítimas dos jurisdicionados. Por fim, apresenta-se sugestões para o aprimoramento no tratamento da matéria de lege ferenda.
