O auge do capitalismo, antevisto por Marx e Engels e propulsionado pelos avanços tecnológicos das últimas décadas, acarretou, principalmente no final do século XX e início do século XXI, um novo fenômeno denominado de transnacional, por meio do qual impõe-se aos Estados-Nações a necessidade de repensar sua soberania em relação aos demais, uma vez que as características dos direitos de terceira geração, também chamados de novos direitos, não delimitam indivíduos nem possuem fronteiras. Essas características acarretaram demandas transnacionais que influenciam na vida de todos os cidadãos do Planeta e para serem reguladas exigem a relativização da soberania do Estado Constitucional Moderno em benefício de uma regulação transnacional. Esta readaptação perpassa pela sustentabilidade como o novo paradigma indutor do direito, juntamente com a liberdade. Apenas um novo paradigma guiado pela questão vital ambiental poderá enfrentar essas novas demandas transnacionais e garantir às presentes e futuras gerações um meio ambiente sadio e equilibrado. Para tanto, indispensável a transnacionalização dos crimes ambientais para efetividade da sustentabilidade do meio ambiente e, por consequência, a criação de um Tribunal Transnacional com jurisdição independente - não apenas subsidiária ou complementar -, capaz de nortear uma ordem punitiva global em que, independentemente do Estado-Nação em que se cometa o dano ambiental, tanto a pessoa física como jurídica e também o próprio ente estatal sofra a mesma punição ou repreensão econômica.
