"A decisão de escrever este livro partiu de um profundo incômodo que sinto em relação a algumas posturas hermenêuticas restritivas da autonomia privada no âmbito do Direito das Sucessões, sempre invocando o direito fundamental de herança como substrato legal para se restringir a liberdade de disposição do titular do patrimônio. Assim ocorre com a possibilidade de renúncia prévia, por cônjuges e companheiros, ao direito concorrencial do art. 1.829, incisos I e II, acoimada de nula por suposta infração ao art. 426 do CC/2002, dispositivo que só se refere à herança e não a todo e qualquer direito sucessório. (...) Em outros termos, quando a favor do autor da sucessão, a interpretação é sempre restritiva, todas as normas são de ordem pública, todos os direitos são indisponíveis, e a liberdade de dispor está sempre posta em numerus clausus. Mas quando se trata de favorecer o herdeiro legitimário, a interpretação é a mais ampla possível, protegendo até mesmo personagens não eleitas pelo legislador. Promove-se, assim, uma interpretação ideológica e parcial do direito de herança, apenas sob a ótica do herdeiro legítimo, passando-se por cima do fato inegável de que esse direito fundamental tem por sujeitos tanto os herdeiros legítimos e testamentários, como o autor da sucessão. Como consectário, e ao mesmo tempo garantia de proteção do direito de propriedade, é possível sustentar que o sujeito do direito de herança é, com muito mais razão, o titular do patrimônio do que o sucessor. É sobre isso que me proponho a refletir nos capítulos que se seguirão, para concluir, em cada um deles, sugerindo uma nova abordagem na interpretação e aplicação do direito fundamental de herança".
