Nella cosiddetta era “delle reti” e della “mondializzazione”, le pratiche di tutela e fruizione dell’ambiente, anche a livello locale, devono rapportarsi alle dinamiche globali e adeguarsi alle politiche di gestione delle aree naturali protette e dei flussi turistici. Ne deriva la necessità di tenere in conto: la complessità delle politiche, degli atteggiamenti, dei metodi e degli strumenti che riguardano la conservazione dei beni naturali; la dimensione etica delle cosiddette “buone pratiche”; l’educazione e la formazione degli utenti (Gambino R., 1991; Zerbi, 2007; Magnaghi 2010). Tutto questo tenendo pure in considerazione: uno sviluppo di ricerche finalizzate alla tutela ambientale e alla promozione dei beni culturali; il sostegno e la sperimentazione di forme di gestione e di uso che permettono uno sviluppo sociale ed economico compatibile con il mantenimento delle risorse naturali e del patrimonio storico-culturale; l’applicazione dei più moderni Sistemi di Gestione Ambientale (ISO 14001). Un corretto sviluppo sostenibile nelle aree protette significa, infine, un controllo delle prestazioni ambientali delle diverse attività svolte, una regolamentazione delle attività di trasformazione e valorizzazione, valutandone gli impatti prodotti, una definizione delle responsabilità, delle prassi, delle procedure e dei processi finalizzati alla gestione complessiva dell’ambito di parco. Un’adeguata gestione delle aree protette e di quelle di “margine” presuppone, quindi, la definizione di obiettivi strategici complessi e finalizzati a raggiungere un equilibrio tra conservazione, sostenibilità e sviluppo. In tal modo la ricomposizione territoriale e la valorizzazione si possono realizzare attraverso: la scelta di attività adeguate, che contribuiscono allo sviluppo socio-economico e alla qualità della vita delle comunità; l’applicazione di strategie di comunicazione, educazione, ricerca, formazione e sensibilizzazione; il coinvolgimento attivo delle comunità e degli enti locali, a tutti i livelli; l’individuazione, la tutela e la gestione delle pratiche e degli usi consolidati del territorio. Una parte maggioritaria dell’opinione pubblica ha ormai raggiunto una sua consapevolezza sull’importanza della conservazione e valorizzazione del patrimonio ambientale, naturale e costruito, benché si renda anche conto, in modo più o meno esplicito, che non sempre tale consapevolezza si traduce in orizzonti operativi né in azioni concrete e continue, con essa coerenti. I casi di studio presentati nelle prossime pagine, che ci porteranno a conoscere alcune aree protette in Italia, Inghilterra, Galles, Scozia, Canada e Perù, ci consentiranno di avere un primo “assaggio” di come i criteri di sviluppo sostenibile, in questi territori “speciali”, non necessariamente siano immediatamente applicabili e che, a volte, essi incontrino delle notevoli difficoltà a essere messi in pratica. This book represents a first attempt to investigate the relations between Law and Agroecology. There is a need to adopt a transdisciplinary approach to multifunctional agriculture in order to integrate the agroecological paradigm in legal regulation. This does not require a super-law that hierarchically purports to incorporate and supplant the existing legal fields; rather, it calls for the creation of a trans-law that progressively works to coordinate interlegalities between different legal fields, respecting their autonomy but emphasizing their common historical roots in rus in the process. Rus, the rural phenomenon as a whole, reflects the plurality and interdependence of different complex systems based jointly on the land as a central point of reference. “Rural” is more than “agricultural”: if agriculture is understood traditionally as an activity aimed at exploiting the land for the production of material goods for use, consumption and private exchange, rurality marks the reintegration of agriculture into a broader sphere, one that is not only economic, but also social and cultural; not only material, but also ideal, relational, historical, and symbolic; and not only private, but also public. In approaching rus, the natural and social sciences first became specialized, multiplied, and compartmentalized in a plurality of first-order disciplines; later, they began a process of integration into Agroecology as a second-order, multi-perspective and shared research platform. Today, Agroecology is a transdiscipline that integrates other fields of knowledge into the concept of agroecosystems viewed as socio-ecological systems. However, the law seems to still be stuck in the first stage. Following a reductionist approach, law has deconstructed and shattered the universe of rus into countless, disjointed legal elementary particles, multiplying the planes of analysis and, in particular, keeping Agricultural Law and Environmental Law two separate fields.
