It departs from the author’s mourning for her parents, their histories and struggles in Germany as Gastarbeiter, while it also engages with the political mourning of intersectional feminist movements against feminicide inCentral and South America; the struggles against state and police misogynoir violence of #SayHerName in the United States; the resistance of refugees and migrantized people against the coloniality of migration in Germany; and the intense political grief work of families, relatives, and friends who lost their loved ones in racist attacks from the 1980s until today in Germany. O presente estudo é resultado de minha Dissertação de Mestrado, desenvolvida no âmbito do Programa de Pós-Graduação em Direito da UFMG e defendida em 2023, em que pretendi investigar a proteção contra danos ocorridos após a morte do sujeito, propondo como tema problema entender e justificar a maneira mais adequada de proteger o morto e de identificar o objeto de tutela dos direitos da personalidade póstumos. Partindo das considerações tecidas pelas teorias da identidade narrativa e da situação jurídica, postulei que a proteção se faz pela constituição de uma situação jurídica socialmente relevante, composta por deveres de respeito à memória em face de circunstâncias concretas, que parte da construção de uma obra realizada em vida pelo próprio morto e se desenvolve rumo à memória da pessoa falecida e a continuação de sua história na forma contada pelas pessoas vivas, na dimensão de recepção e leitura do texto narrado. No percurso do livro, desenvolvi as temáticas da presença da pessoa falecida no contexto social-digital; da noção adequada de identidade que explicitasse essa permanência prático-social; da visão adequada do ordenamento jurídico quanto à proteção devida à pessoa falecida, por meio dos estudos sobre memória, testemunho e danos; por fim, encerrei com análise de casos de danos póstumos, em que busquei desenvolver uma estratégia argumentativa que permita a avaliação da situação, particularmente quanto às pessoas legitimadas e o período temporal de proteção.
