State building is an ongoing process that first defines legitimate citizenship and then generates citizens. Political analysts and social scientists now use the concept of citizenship as a lens for considering both the evolution of states and the development of their societies. In Citizenship as a Regime leading political scientists from Canada, Europe, and Latin America use insights from comparative politics, institutionalism, and political economy to understand and analyze the dynamics of contemporary policies and politics. This book celebrates Jane Jenson's work and many of her contributions to political science and the study of Canadian politics. Featuring Jenson's concept of "citizenship regime", the collected chapters consider its theoretical and methodological underpinning and presents new applications to various empirical contexts. Successive amendments in the citizenship law in India have spawned distinct regimes of citizenship. The idea of citizenship regimes is crucial for making the argument that law must be seen not simply as bare provisions but also examined for the ideological practices that validate it and lay claims to its enforceability. While citizenship regime in India can be distinguished from one another on the basis on their distinct political and legal rationalities, cumulatively they present a movement from jus soli to jus sanguinis. The movement towards jus sanguinis has been a complex process of entrenchment of exclusionary nationhood under the veneer of liberal citizenship. This work argues that the contemporary landscape of citizenship in India is dominated by the Citizenship Amendment Act (CAA) 2019 and the National Register of Citizens (NRC). The CAA 2019 and the NRC emerged as distinct tendencies from the amendment in the citizenship law in 2003. These tendencies subsequently become conjoined in an ideological alignment to make citizenship dependent on lineage, spelling out ideas of belonging which are tied to descent and blood ties. The NRC has invoked the spectre of 'crisis' in citizenship generated by indiscriminate immigration and the risks presented by 'illegal migrants', to justify an extraordinary regime of citizenship. The CAA provides for the exemption of some migrants from this regime by making religion the criterion of distinguishability. The CAA 2019 and NRC have generated a regime of 'bounded citizenship' based on the assumption that citizenship can be passed on as a legacy of ancestry making it a natural and constitutive identity. The politics of Hindutva serves as an ideological apparatus buttressing the regime and propelling the movement away from the foundational principles of secular-constitutionalism that characterised Indian citizenship in 1949.

This book is the first comprehensive examination of the citizenship regimes of the new states that emerged out of the break up of Yugoslavia. It covers both the states that emerged out of the initial disintegration across 1991 and 1992 (Slovenia, Croatia, Bosnia-Herzegovina, the Federal Republic of Yugoslavia and Macedonia), as well as those that have been formed recently through subsequent partitions (Serbia, Montenegro and Kosovo). While citizenship has often been used as a tool of ethnic engineering to reinforce the position of the titular majority in many states, in other cases citizenship laws and practices have been liberalised as part of a wider political settlement intended to include minority communities more effectively in the political process. Meanwhile, frequent (re)definitions of these increasingly overlapping regimes still provoke conflicts among post-Yugoslav states. This volume shows how important it is for the field of citizenship studies to take into account the main changes in and varieties of citizenship regimes in the post-Yugoslav states, as a particular case of new state citizenship. At the same time, it seeks to show scholars of (post) Yugoslavia and the wider Balkans that the Yugoslav crisis, disintegration and wars as well as the current functioning of the new and old Balkan states, together with the process of their integration into the EU, cannot be fully understood without a deeper understanding of their citizenship regimes. This book was originally published as a special issue of Citizenship Studies.
