From the 16th to the 18th centuries French private law was very different in the various parts of the country. In northern and central France there were as many as 65 general customs in force, as well as over 300 local customs, often differing from them in detail. As the feeling of nationhood grew, so did the idea of replacing the existing variety of laws by a single private law, possibly a code, common to all of France. "A single body of law, called the Code Civil is to be created." So proclaimed the law of 21 March 1804 (30 Ventse year XII). It was to be created by the amalgamation of 36 texts recently adopted. This was the culmination of an enterprise started many years previously. The idea of unifying French private law, conceived under Louis XI, had been frequently repeated since then, but under the ancien regime lawyers never got beyond sketching and planning. Proper drafts of a civil code were put to assembly after assembly under the Revolution, but in ten years none was ever adopted. This book charts the formation of the French Civil Code, examining both the public and private effects. It analyses the Code using contemporary and modern sources, including a very beautiful and concise extract from H. A. L. Fisher's "History of Europe" which gives an English historian's appraisal of Napoleon's contribution to the Code Civil.

The provisions of the French Civil Code governing the law of obligations have remained largely unchanged since 1804 and have served as the model for civil codes across the world. In 2016, the French Government effected major reforms of the provisions on the law of contract, the general regime of obligations and proof of obligations. This work explores in detail the most interesting new provisions on French contract law in a series of essays by French lawyers and comparative lawyers working on French law and other civil law systems. It will make these fundamental reforms accessible to an English-speaking audience.

Excerpt from A Comparative Glance at the French Code Civil and the Proposed New York Civil Code As We, though less than other nations, are greatly indebted to the Roman laws as codified by Justinian, it may not be uninteresting to glance at their origin. In the early centuries of the Roman State the law was uncertain and unfixed until in the year of Reine 303 the ten. and in 304 the famous XII tables were compiled, this being the oldest known compilation of laws. As time were on and the State grew in extent, population and civilization, these were found insufficient and were supplemented by the plebescite or ordinances of the plebelans and the scnatus consulta, decrees of the senate, the cmctorztas prudentum and jus civilc, or decisions of the jurists. Later, another form of laws called the pretorum edicts arose, and, under the Empire, the Imperial Constitutions. These, however, and especially the latter, grew so numerous that under Theodosiiis, and afterwards Constantine, they were codied. This was, however, so imperfectly done that Justinian, in 528, ordered a new Code to be formed, which was completed in the following year by Triboniaii and revised some years later. This, with the Pandects, formed the law of all parts of the Eastern and Westei nEmpire, before and after its fall; of Europe during the dark and middle ages, coexisting as canonical law with the customs and usages which grew up in various parts of Europe; and even new forms the basis to a great extent of the jurisprudence of the Latin races, and to some extent of all others. The Code Napoleon was the outcome of the French Revolution, of the destruction of the old world, of feudalism, privileges, exclusiveness and tyranny. It was the consecration of the principles of liberty and equality which the Revolution established. It inaugurated a new moral and physical life for the people, who had previously been little higher in the social scale than the cattle attached to the soil. It retained what was equitable and just in the old laws and customs and abolished what was inequitable, such as the feudal tenure of land, priinogeniture, entail, the discrimination against aliens, the vast privileges of the nobility and clergy, etc., etc. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
