The history of patent harmonization is a story of dynamic actors, whose interactions with established structures shaped the patent regime. From the inception of the trade regime to include intellectual property (IP) rights to the present, this book documents the role of different sets of actors – states, transnational business corporations, or civil society groups – and their influence on the structures – such as national and international agreements, organizations, and private entities – that have caused changes to healthcare and access to medication. Presenting the debates over patents, trade, and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement), as it galvanized non-state and nonbusiness actors, the book highlights how an alternative framing and understanding of pharmaceutical patent rights emerged: as a public issue, instead of a trade or IP issue. Although ideally a patent system for pharmaceuticals should serve to incentivize research into the development of new medicines, the COVID-19 pandemic has exposed the equal importance of drug access and affordability. This book, by focusing on the Brazilian rule which makes the grant of pharmaceutical patents dependent on the prior consent of the National Health Surveillance Agency (ANVISA), shows how the Brazilian model affords an example for other countries to follow in dealing with tensions between patent protection and the right to healthcare. Based on an empirical study in which the author examined 147 reports issued by ANVISA as a basis for its decisions, the book deals with such central questions concerning the interface of regulation and innovation in the patent system as the following: compatibility between ANVISA’s prior consent mechanism and the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement; how “evergreening” and “trivial patents” undermine public health and access to medicines; ways of correcting abuses of patent rights and controlling quality of patents; and the discourse on health as a human right. Along with her examination of ANVISA reports, the author analyzes how Article 229-C LPI, which introduced the need of ANVISA’s prior consent to the patent grant of pharmaceuticals in Brazil, has been interpreted in Brazilian case law. Interviews with Brazilian experts are also included. In its commitment to harmonizing patent rights and the right to access of affordable medicines, Brazil’s patent system for pharmaceuticals stands out as a workable response to the basic problem of access to medicines in the developing world. This book explores the emergence of a new developmental state in Latin America and its significance for law and development theory. In Brazil since 2000, emerging forms of state activism, including a new industrial policy and a robust social policy, differ from both classic developmental state and neoliberal approaches. They favor a strong state and a strong market, employ public-private partnerships, seek to reduce inequality, and embrace the global economy. Case studies of state activism and law in Brazil show new roles emerging for legal institutions. They describe how the national development bank uses law in innovation promotion, trade law strengthens new developmental policies in export promotion and public health, and social law frames innovative poverty-relief programs that reduce inequality and stimulate demand. A tuberculose ainda persiste como problema de saúde pública mundial, atingindo principalmente populações negligenciadas nos países em desenvolvimento e menos desenvolvidos. O arsenal terapêutico antituberculose passa por um processo de estagnação, e boa parte dele é obsoleto e tem propiciado, inclusive, o aparecimento de cepas resistentes da tuberculose. O panorama geral de combate à tuberculose, em duas décadas, conta com 1.005 ensaios clínicos, 5.563 patentes, ambos em 96 países, 20 tipos de medicamentos, 17 novas tecnologias (10 farmacológicas e sete não farmacológicas) que estão em fase avançada de desenvolvimento. No Brasil, existem oito empresas produtoras e duas empresas fornecedoras de medicamentos antituberculose, que somam 82 registros ativos na Anvisa. Foi aplicado questionário on-line, com 92 perguntas, ao público alvo composto por pesquisadores que atuam nos Institutos Nacionais de Ciência e Tecnologia em Tuberculose (INCT-TB) e em Gestão da Inovação em Doenças Negligenciadas (INCT-IDN), e na Rede Brasileira de Pesquisas em Tuberculose (Rede-TB), com a chancela do Comissão Nacional de Ética em Pesquisa (Conep) do Ministério da Saúde. O tratamento estatístico dos dados pautou-se pela análise multivariada fatorial. As simulações computacionais foram conduzidas por meio do software Statistical Package for the Social Sciences (SPSS). Com os resultados sobre as ações estratégicas, foram mapeadas cinco vertentes de atuação para a induzir e institucionalizar políticas públicas inovadoras pautadas pelo benchmarking em áreas de grande similaridade com os desafios encontrados no combate à tuberculose, quais sejam: "Os incentivos ao tratamento da tuberculose"; "Os novos produtos anti TB"; "A inovação nas parcerias público-privadas"; "A inovação nas parcerias público-privadas transfronteiras" e "As patentes anti TB", esta última com 15 subações específicas. Diante do exposto, foi elaborado um modelo inovador para construção de políticas públicas para a tuberculose, denominado Modelo Cognitivo Banerjee Azul (MCBA). Tal modelo foi estruturado pelo Estado empreendedor que se compõe por 11 eixos, dos quais, dois são internacionais, e os outros nove eixos são nacionais, intrinsecamente relacionados com 16 dimensões que possuem aspectos necessários para a construção de novas políticas públicas de saúde e de patentes dedicadas ao combate da tuberculose no Brasil.
