La substitution fidéicommissaire pour le surplus est une institution juridique permettant au testateur d'étendre son pouvoir de disposition sur deux générations successives. Très populaire à l'époque romaine, cette institution a su traverser les siècles pour se retrouver aux art. 488 ss CC. Cette thèse de doctorat retrace l'histoire fascinante de la substitution fidéicommissaire, son existence dans les pays voisins et surtout son application et ses effets en droit suisse. L'analyse suit les trois étapes clés, soit les motivations du de cujus à choisir une substitution pour le surplus, l'ouverture de la succession en faveur du grevé et finalement l'ouverture de la substitution fidéicommissaire en faveur de l'appelé. L'auteure met en évidence les nombreuses controverses doctrinales ayant cours lorsque la substitution est réduite au solde, notamment sur la question de l'étendue du pouvoir de disposition du grevé ainsi que ses conséquences en cas d'abus de son pouvoir. Elle met également en lumière les difficultés que pose l'art. 492a CC. Tant les praticiens que les étudiants pourront y trouver des exemples et des schémas permettant d'illustrer la mise en œuvre de cette institution.

In 1999, a suite of three new conditions of contract was published by FIDIC, following the basic structure and wording harmonised and updated around the previous FIDIC Design-Build and Turnkey Contract (the 1992 ‘‘Orange Book’’). These conditions, known as the ‘‘FIDIC rainbow, were the Conditions of C- tract for: l Construction, the so-called Red Book, for works designed by the Employer l Plant and Design-Build, the so-called Yellow Book, for works designed by the Contractor l EPC/Turnkey Projects, the so-called Silver Book, for works designed by the Contractor The ?rst is intended for construction works where the Employer is responsible for the design, as for per the previous so-called Red Book 4th Edition (1987), with an important role for the Engineer. The other two conditions of contract are intended for situations when the Contractor is responsible for the design. The Plant and Design-Build Contract has the traditional Engineer while the EPC/Turnkey Contract has a two-party arran- ment, generally with an Employer’s Representative as one of the parties.

Gary L. Francione is a law professor and leading philosopher of animal rights theory. Robert Garner is a political theorist specializing in the philosophy and politics of animal protection. Francione maintains that we have no moral justification for using nonhumans and argues that because animals are property or economic commodities laws or industry practices requiring "humane" treatment will, as a general matter, fail to provide any meaningful level of protection. Garner favors a version of animal rights that focuses on eliminating animal suffering and adopts a protectionist approach, maintaining that although the traditional animal-welfare ethic is philosophically flawed, it can contribute strategically to the achievement of animal-rights ends. As they spar, Francione and Garner deconstruct the animal protection movement in the United States, the United Kingdom, Europe, and elsewhere, discussing the practices of such organizations as PETA, which joins with McDonald's and other animal users to "improve" the slaughter of animals. They also examine American and European laws and campaigns from both the rights and welfare perspectives, identifying weaknesses and strengths that give shape to future legislation and action.

The Universal Soil Loss Equation (USLE) enables planners to predict the average rate of soil erosion for each feasible alternative combination of crop system and management practices in association with a specified soil type, rainfall pattern, and topography. When these predicted losses are compared with given soil loss tolerances, they provide specific guidelines for effecting erosion control within specified limits. The equation groups the numerous interrelated physical and management parameters that influence erosion rate under six major factors whose site-specific values can be expressed numerically. A half century of erosion research in many States has supplied information from which at least approximate values of the USLE factors can be obtained for specified farm fields or other small erosion prone areas throughout the United States. Tables and charts presented in this handbook make this information readily available for field use. Significant limitations in the available data are identified.
