L’idea di un commentario al Contratto collettivo per il settore metalmeccanico sottoscritto nel febbraio di quest’anno trova la propria origine da un lato nella centralità storica del settore nel nostro sistema di relazioni industriali, dall’altro nel fortissimo ricordo di uno studente di Giurisprudenza (il sottoscritto) che, nell’affrontare l’esame di Diritto del lavoro trovò tra i materiali “Commento al contratto collettivo nazionale 1° maggio 1976 per i lavoratori addetti all’industria metalmeccanica privata”, con contributi di P.G. Alleva, F. Carinci, G. Giugni, G.F. Mancini, P. Tosi, 1978, per i tipi di Zanichelli 1. E a seguire può anche essere ricordato, nel 2010, il Commentario al contratto collettivo dei metalmeccanici del 2008, curato da Massimo Roccella e Gianni Garofalo per Cacucci. Insomma, il Ccnl da “oggetto astratto” di studio nell’ambito della disciplina diviene “soggetto”, protagonista della vita scientifica e pratica della materia giuslavoristica.

The book addresses how power and power resources remain important analytically as well as empirically dimensions for analysing contemporary capitalism. It provides a theoretical framework for studying, understanding, and explaining changes in the world of work and how that leads to changes in contemporary capitalist societies. Changes in the world of work are closely related to increasing inequality, growing social unrest, and societal polarisation. Hence the book seeks to deepen our understanding of how developments in the sphere of work have implication far beyond the direct impact on workers. The book focuses on how workers and unions utilise their various power resources to off-set the power advantage of employers and capital in the sphere of labour politics, which have crucial linkages with both cultural life, politics, and the market. Although workers’ and unions’ power and influence have been declining almost universally across the world, the argument in the book is that they still hold power resources that can challenge and sometimes alter outcomes in another direction than what employers and capital wants. Hence the theory can help understand the possibilities that workers and unions still have and how these resources affect the outcomes of the labour-capital struggle. A core contribution of the book is that it develops theoretical propositions about power resource theory, provides clear definitions of the core concepts as well as apply the power resource theory to a range of new or emerging topic fields like global value chains, minimum wages, and migrant workers.

Ad iniziativa dell’Associazione Giuslavoristi Italiani, con il patrocinio di Università degli Studi di Bari, Ordine degli Avvocati di Taranto, Fondazione Scuola Forense di Taranto, Camera dei Giuslavoristi di Taranto, INAIL Regione Puglia e ANMIL, si è svolto a Taranto il 18 novembre 2022, presso la sede del Dipartimento Jonico in Sistemi Giuridici ed Economici del Mediterraneo, un convegno nazionale dedicato al tema della tutela della salute e dell’ambiente di lavoro, interno ma anche esterno all’impresa, considerate le frequenti ricadute ambientali di determinate lavorazioni. In questa prospettiva il convegno si è articolato in due sessioni, di cui la prima dedicata alla tutela del lavoratore tra prevenzione e protezione, e la seconda incentrata sull’apparato rimediale e sanzionatorio recato dal decreto legislativo n.81 del 2008, Testo Unico in materia prevenzionale. Il dibattito è stato alimentato da numerose ed articolate relazioni, sviluppate da avvocati e magistrati del lavoro che si occupano in modo non occasionale delle tematiche della sicurezza sul lavoro, e sono state incentrate sui profili più problematici della materia, onde fornire suggerimenti e supporto esperenziale agli avvocati e ai magistrati che abitualmente si occupano di tali questioni. La riuscita dell’iniziativa convegnistica e lo spessore di tutte le relazioni sviluppate oralmente ha suggerito l’opportunità e al contempo l’utilità di raccogliere gli scritti delle stesse, idoneamente rielaborate, in questo libro.
