O Instituto Nacional do Seguro Social (INSS) ocupa duas posições de destaque no Direito brasileiro. Ao mesmo tempo em que se trata da entidade detentora da nobre missão de mediar o acesso às aposentadorias, pensões e auxílios fornecidos pelo Regime Geral de Previdência Social (RGPS), a autarquia também assumiu o posto de “maior litigante do país”. Esses dados revelam a feição contraditória da Seguridade Social brasileira: a instituição pública especificamente concebida para resguardar os cidadãos abalados por contingências sociais é justamente aquela que mais trava conflitos com os usuários de seus serviços. Ocorre que os conflitos instaurados entre os segurados e o INSS não refletem contingências aleatórias, tampouco incidentes isolados. Na realidade, eles decorrem da incorporação de padrões de conduta contrários à lei e à Constituição nas rotinas internas da autarquia. A desconsideração do posicionamento das Cortes na tomada de decisões administrativas, a promulgação de atos normativos contra legem e a excessiva demora na apreciação dos requerimentos endereçados pelos segurados são algumas das rotinas operacionais do INSS que desencadeiam violações massivas a direitos e afetam um universo indeterminado de cidadãos. As respostas disponibilizadas pela litigância individual se revelam notoriamente insuficientes para resolver os problemas diagnosticados na “sala de máquinas” da administração previdenciária. Decisões proferidas em demandas individuais se adstringem a conceder benefícios em favor de um único segurado, sem ensejar mudanças macroscópicas ou conjunturais nas rotinas internas do INSS. Diante desse intrincado cenário, diversas indagações irrompem no horizonte da comunidade jurídica. Quais padrões de conduta do INSS se mostram incompatíveis com os desígnios da Seguridade Social brasileira? Por que a autarquia insiste em adotar práticas institucionais notoriamente rechaçadas pelos Tribunais? Como incitar o INSS a modificar o seu modus operandi, de modo a cessar definitivamente padrões de conduta tidos como inadequados? Com o objetivo de responder aos referidos questionamentos, a obra se debruça sobre a técnica que a doutrina tem alcunhado de processo estrutural e investiga de que forma ela pode ser aplicada ao cenário da litigância previdenciária.
