Num texto objetivo e enxuto, o autor esclarece os principais pontos e sinaliza as potencialidades para o futuro das cidades brasileiras.A Parceria Público-Privada, também conhecida por PPP, é um contrato de concessão pública pelo qual o ente estatal (poder concedente) delega à iniciativa privada (concessionário) a prestação de um serviço público específico, necessariamente envolvendo contraprestações ou aportes pagos pelo erário público ao parceiro privado, ainda que seja apenas a título de complemento de tarifas para a cobertura de lacunas de viabilidade.A legislação brasileira trata as concessões públicas que não envolvam remuneração (ou aportes) pagos pelo poder concedente ao concessionário como concessão comum, excluindo-as da categoria de PPP. As concessões comuns são, portanto, integralmente remuneradas pelo pagamento de tarifas pelo usuário diretamente ao concessionário privado. Este é o principal elemento de distinção para se enquadrar ou não um contrato público como PPP.O serviço concedido pode incluir o projeto, a construção, o financiamento, a operação e a manutenção (design, build, finance, operation and maintenance - DBFOM) envolvendo ou não a construção ou ampliação de infraestrutura. No Brasil, para ser classificada como PPP, uma concessão não pode ser composta apenas por projeto e construção (design, build), porque isso se confundiria com a simples contratação de serviços de construção civil, o que já está previsto em outra modalidade de contrato público regido pela Lei 8.666/93.A ideia da PPP é transferir à iniciativa privada parcela significativa dos riscos de projetos de grande porte, antecipar investimentos públicos, alavancar financeiramente um projeto para que haja ganhos sociais agregados, e reduzir custos totais de forma a incentivar o parceiro privado a construir e operar com qualidade o ativo concedido. Numa PPP, o concessionário privado é remunerado pelo desempenho na prestação do serviço, cujos padrões mínimos de qualidade e desempenho são pré-estabelecidos em contrato, conforme determina a legislação pertinente.
