…We are under pressure in rethinking and unthinking of the whole of the European Union history, after big waves of union’s earthquakes, by mentioning here the big financial crisis between 2008-2010, or Brexit of Great Britain, an embittered fought inside of the European Union between the years 2016 and the present 2020… …It is not mentioned here the waves of migrants in the last ten years towards European Union, through which a world of social pathology is accompanied and enhanced by a dramatic pandemic’s world of biologic pathology, this worst issues of viral disease, out-breaking in the year 2020… …We will remake another configuration of the initial CONSTITUTION OF EUROPE, written and published with about 15 years ago, resembling a parallel dialectical becoming between a finisher and a re-finisher in constitution or between an influencer and re-influencer in social sciences… Terminology of different constitutions will be different in their substance and their semantics, reflecting the difference in temporality and creativity of the author, but the basic principles of ethics and morality are into the both constitutions, the sameness … If European Union needs a constitution, then, European Union must know the history of Europe, must know the inhabitants, the native, the people and citizens of Europe, the science and technology of Europe, the art and religions of Europe, the geography and demography of Europe, since the oldest times of Upper Paleolithic, of Neolithic, of Antiquity, of Middle Age, of Renaissance, of Enlightenment, of Modern Times and of present Third Millennium, all in detail, in reality, in morality and rationality… More than that, our Constitution of European Union is desired to be and to become, a pilot project in searching and researching in anthropo-sapientology, a vector of axiological and epistemological substance in knowledge and discoveries… …It is the first time in Human Known History and Historiology, when, a Constitution is becoming also a vector of knowledge, sensing and resensing a searching and researching project in Antropos-Sapientology, finally, a form of concrete epistemology, a substantial gnoseology, having an explicit and implicit proper function of axiology in oneself, for oneself and through oneself… Constitutionalist of European Union

This book analyses the EU's Constitutional Treaty, which emerged in draft form from the European Convention in the summer of 2003 and which was finalised by an Intergovernmental Conference (IGC) in June 2004. It describes the main novelties of the treaty and looks at policies of important actors, Member States and Community actors (the Commission and European Parliament) and the roles played by the Convention and the Italian and Irish Presidencies during the process of deliberation and negotiation that produced the treaty. It further studies the failure of ratification in France and the Netherlands and the implications for the process of European integration of this failure. It finally touches on the question whether a constitutional equilibrium has been reached. Since the new Lisbon Treaty negotiated in 2007 contains much of what was in the Constitutional Treaty the analyses of the book remain pertinent for this latest EU treaty.

The third edition of this acclaimed book continues the story of the EU's constitutional journey. The EU's constitution, composed of myriad legal texts, case law and practice, is no less of a moving target than before and the pace of change has, if anything, increased since the publication of the second edition. In a constantly challenging geopolitical context, the EU faces unprecedented political, economic and cultural trials, all of which impact upon the evolution of its constitution. In particular, the migration crisis has given rise to the need for substantial revision of the chapter dealing with the area of freedom, security and justice, and the institutional reforms embarked upon in the quest to restore financial order have taken a more structured form following the inception of a European banking union. Fully updated to include the ramifications of Brexit, the book succeeds – where others have struggled – in making sense of the EU's complex constitutional order, focusing on its essential features but taking into account the profound changes that have taken place over the past 20 years. The EU has become much more than an internal economic market. Recently it may even be argued that the focus of action has been in areas such as immigration and third-country nationals, security and defence policy, and penal law and procedure, and the work towards creating a European banking union underlines the continued need to monitor economic and fiscal policy. Eschewing too much detail, the authors underline the essential values, principles and objectives of the integration regime as well as its basic normative structure and hierarchy. In this context, the decentralised nature of the EU is highlighted as an integral part of its constitutional make-up. Recurring themes include European citizenship, fundamental rights and the rule of law. The book also confronts head-on the problems and challenges facing the Union and the gap which is often perceived between lofty ideals and harsh realities. The book will be useful to students of EU law and European integration but will also appeal to a broader audience of researchers and practitioners, including political scientists.

With a foreword by Atzo Nicolaï, Minister for European Affairs of the Kingdom of the Netherlands On 29 October 2004, the Treaty Establishing a Constitution for Europe was signed by the leaders of the 25 Member States of the European Union. This event marked the end of the discussion rounds to amend the treaties on which the European Union is founded. Yet, the debate on the Constitution was far from over when on 29 May and 1 June 2005 the French and the Dutch voters rejected the Treaty. Politicians and lawyers are now confronted with the question of how to proceed and how to go forward. In October 2004, the T.M.C. Asser Institute in The Hague, The Netherlands, organized the 34th Session of its Asser Institute Colloquium on European Law, which was entitled ‘The EU Constitution: The best way forward?’. During the Conference some 50 experts from the 25 Member States, from candidate, potential candidate and neighbouring countries, as well as from the US and Russia focused on key topics like: the process and impact of EU constitution-making, the democratic life of the EU, improving the efficiency and quality of legislation in the EU, the expansion of executive, judicial and legislative powers, and the access to justice. In anticipation of the developments after the signing of the Treaty, three eminent speakers – Prof. Joseph Weiler (New York University), Professor Bruno de Witte (European Institute in Florence) and Professor Jo Shaw (University of Manchester), elaborated on many answers in case of a ratification crisis. This book contains the proceedings of the three-day Conference and includes, next to the papers of the speakers and commentators, reports of the discussions on each topic and the texts of two keynote speeches. A keyword Index and a List of Articles (of the Treaty Establishing a Constitution for Europe, the Treaty on European Union and the Treaty Establishing the European Community) greatly enhance the accessibility of the rich materials. The book will be of great help and interest to political leaders, members of parliament, international lawyers and European citizens in formulating answers to the questions that have risen after the rejection of the Treaty by the French and Dutch voters and give powerful impulses to the continuing debate and efforts to arrive at a generally accepted Constitution for Europe. Deirdre Curtin is Professor of European and International Governance at Utrecht School of Governance, Utrecht, The Netherlands. Alfred E. Kellermann is Senior Legal and Policy Advisor and Visiting Professor in the law of the EU at the T.M.C. Asser Institute and Steven Blockmans is a Senior Researcher in the law of the EU at the T.M.C. Asser Institute, The Hague, The Netherlands.
