Depuis sa création, le Conseil de l'Europe a mis en place un système juridique commun aux Etats européens, fondé sur la démocratie, la prééminence du droit et les droits de la personne. Son œuvre normative a aidé ses membres à répondre aux défis que leur posait l'évolution de la société et a été diffusée à tout le continent européen grâce à l'élargissement géographique sans précédent de l'Organisation depuis 1989. Le Conseil de l'Europe a dans ce contexte joué un rôle déterminant dans l'adhésion des nouveaux Etats à l'Union européenne. La première partie de l'ouvrage aborde le droit " constitutionnel " du Conseil de l'Europe, c'est-à-dire son droit statutaire au sens large. Y est abordé le Statut de 1949 qui, avec les autres textes statutaires de l'Organisation, fixe les objectifs et précise la composition et les modalités de fonctionnement.
