Il primo, anche in ordine di pubblicazione, è il volume di Carmela Marchese, La tutela del cane randagio nelle pubbliche amministrazioni, che si occupa segnatamente della prospettiva del cane all’interno della società civile e, soprattutto, di come viene gestito il fenomeno del randagismo da parte delle Istituzioni. Il secondo volume che lambisce la tematica oggetto della presente pubblicazione è quello intitolato Convivere con gli animali: le ricadute civili e penali della responsabilità per fatto dell’animale. Quest’ultimo affronta i profili civilistici e penalistici derivati dalla “onnipresenza animale” nella vita contemporanea (secondo una felice espressione utilizzata dalla professoressa Silvia Buzzelli nel volume I giorni scontati. Appunti sul carcere, 2012) e, per meglio dire, quali sono le conseguenze della convivenza uomo-animale nel tessuto sociale contemporaneo, limitatamente agli animali per cui è identificabile un proprietario/custode/utilizzatore/ che è responsabile per il fatto dell’animale. - La situazione muta prospettiva se si puntano i riflettori sugli animali selvatici o randagi/abbandonati. Alla gestione dei danni provocati da questi ultimi è dedicato il presente volume, mentre per il risarcimento danni provocati dalla fauna selvatica sarà pubblicato un volume ad hoc. - La presente divulgazione – da utilizzarsi, per alcuni profili, in combinazione con il volume n. 7 – si sofferma sull’indagine relativa al legittimato passivo di azioni di responsabilità per risarcimento del danno provocato da animali randagi, alla luce del variegato e stratificato panorama normativo costituito dalla legge quadro n. 281/91 e dalle leggi regionali di esecuzione. Un’ampia casistica – quale emergente dalle pronunce delle corti della Penisola – dipinge lo stato attuale della giurisprudenza e costituisce un primo strumento per rinvenire la frammentata disciplina normativa e per consentire agli operatori di valutare le strategie difensive per la migliore tutela del danneggiato. - Il volume, poi, oltre a rinviare alle azioni positive perseguibili per arginare un fenomeno che non accenna a ridimensionarsi, con importanti ricadute anche sul bilancio degli enti pubblici, critica talune risposte deleterie (canili lager) o, comunque, illecite (ordinanze che vietano di alimentare i randagi). Infine, uno spazio è dedicato alle connessioni tra randagismo e Codice della Strada, come innovato dalla legge n. 120 del 2010 e dai decreti attuativi.
