In this book, the ERECO-PGV[1] network wishes to make an overview of the cooperation implemented by and in the European Union and to describe the concrete forms they have taken. The issue is to analyze the internal European cooperation between economic actors, politicians, and EU citizens at different levels, but also to focus attention on the external cooperation (neighborhood policies, external policies, and collaborations with international institutions: NATO, OECD, WTO, etc.). Carrying uncompromising attention on this issue means rethinking the European project in light of today's challenges. From the very beginning, the EU was based on and called for forms of multinational cooperation, bilateral (internal and external) at different levels, involving economic actors, public actors, local authorities, and civil society. The frameworks for this cooperation as well as for the successive enlargements of the EU were drawn up in the context of European negotiations, in particular during discussions on the European Treaties. European values, standards, and rules are embodied in the texts of agreements, resolutions, and European directives and Treaties signed by all member countries. They establish the functioning of European institutions and the framework of democratic life in Europe. The emergence of current crises (Brexit, COVID-19, migration crisis, non-respect of rule of law rules, refusal of certain member countries to apply the European Charter of Human Rights, etc.) is questioning the project of the European Union and introduced the challenges which should be overcome by the proposal of the new project able to face the internal complexity of the Union and to answer to the pressure of a conflicting international context. What remains of the European ideal affirmed in the treaties of 1957, 1992, and 2007? How to "re-enchant" the common project? Yet, the European Union remains attractive to new candidate countries. How do they read the integration conditions into the EU with regard to their own projects?

At the beginning of 2022, a major EU enlargement seemed unlikely in the near future. However, Russia’s invasion of Ukraine in February 2022 fundamentally shifted the European Commission’s stance. Ukraine and Moldova were granted EU candidate status, and Georgia was added to the list of potential candidates. This raises questions about the future of the European Neighbourhood Policy. While EU enlargement has gained momentum, certain areas of integration have stalled, such as the expansion of the eurozone and the Schengen area - despite Croatia’s recent accession, Romania and Bulgaria remain in waiting. Meanwhile, new formats of continental cooperation, such as the European Political Community, launched in 2022, raise the question of whether more differentiated integration models will emerge. Additionally, the war in Ukraine has exacerbated other crises, including inflation, the energy crisis, food shortages in the Global South, and unprecedented refugee movements - not only from Ukraine but also other regions. Against this backdrop, the 14th Network Europe Conference examined EU enlargement prospects and the challenges facing European integration in times of global crisis. This book explores the question of how the EU understands the ‘rule of law’ in its external relations, with a particular focus on development cooperation and enlargement. Although the EU’s commitment to the rule of law is strong, the relevant concept remains nebulous. On the basis of a detailed analysis of two key EU external policy areas, the main argument advanced is that the Union has adopted a mostly ‘institutional’ approach to the concept by focussing largely on judicial reform. International Competition Law Series#91 Enforcement of competition law often calls for a complex economic and legal assessment, and the review of those enforcement decisions usually falls to national courts. In this connection, however, European competition law and legal scholarship have offered scant guidance on how judicial review should and does function. This book, the first comprehensive, systematic, and comparative empirical study of judicial review of competition law public enforcement in the EU and the UK, provides a thorough understanding of the practical operation of the role of judicial review in competition enforcement. Do Member States of the EU have a free hand in drafting Accession Treaties, or are there legal constraints on their primary law-making powers in this regard? That is the main question this book addresses. It argues that such constraints do exist, and seeks to identify them, thereby providing a number of insights into the nature of the EU’s legal order. The point of departure as well as the main focus of the study is the proposed permanent safeguard clause (PSC) on the free movement of persons in the Negotiating Framework for Turkey. Legal provisions, rules, principles and norms that might constrain Member States in this regard are identified with reference to the PSC. The book examines constraints on Member States stemming from three sources of EU law: Association Law, based on the existing legal framework built on the EEC-Turkey Association Agreement (Part I); EU Enlargement Law, comprised of past practice and existing EU rules on enlargement (Part II); and the foundations of EU Constitutional Law (Part III), which constrain Member States whenever they act within the scope of Union law both as primary and secondary lawmakers. Part III reveals what the Court of Justice of the EU considers to be the essence or the ‘very foundations’ of the Union’s legal order, which it protects against encroachment. This is similar to what some constitutional courts do to protect the ‘inner unity’ or ‘basic structure’ of their constitutions. The findings of this book can be applied to the accession of any candidate state. It also sheds light on important implications for future treaty amendments, and for identifying possible limits to differentiated integration.
