Em 2019, o STF julgou parcialmente procedente a ADO 26/DF e o MI 4.733/2019, no sentido de reconhecer que o Congresso Nacional estava em mora ao não criminalizar condutas discriminatórias que tenham como motivo a orientação sexual e a identidade de gênero. Decidindo que, enquanto o Congresso não legislar sobre o tema, a discriminação com fundamento LGBTIfóbico passa a ser considerada crime de racismo, reconhecendo o caráter sócio-histórico da categoria raça que englobaria os sujeitos LGBTIs como "raça social". Tal equiparação e criminalização via judiciário não têm precedentes no mundo. Diante disso, a presente pesquisa buscou contribuir para a compreensão das dinâmicas sociais e políticas que levaram o STF a criminalizar condutas LGBTIfóbicas como práticas racistas. Para responder a essa pergunta, discute-se aqui como se dão os processos de racialização, para avaliar o sentido e fundamentação do conceito de "raça social", comparando com as teorias sobre gênero e sexualidade. Observando, também, os documentos processuais do julgamento. A partir do pesquisado, sobre a raça social, entende-se que toda raça é social. Logo, não houve inovação em relação ao conceito ou a entendimento científico. O que houve foi uma racialização estratégica provisória para a proteção de sujeitos LGBTIs sob a vigência da principal lei antidiscriminatória do país, a Lei no 7.716/89, que pune os crimes resultantes de discriminação ou preconceito de raça, cor, etnia, religião ou procedência nacional.

This book brings together studies that contribute to the emergence of a latinx queer psychology. LGBTQ+ studies have gradually included the perspective of sexual and gender diversity, but they have been predominantly elaborated from North American and European perspectives. This book focuses on different understandings and practices developed by Latin American researchers that contribute to a broader application of psychological knowledge in LGBTQ+ studies, as well as sexual and gender diversity issues, but goes beyond the region by also incorporating chapters written by European and North American authors influenced by latinx perspectives. Latin American psychology has developed original approaches to LGBTQ+ studies based on a new theoretical critique to the mainstream psychological theories that has given rise to a new queer psychology. Reconocen que la cultura machista acendrada y la opinión pública adversa, así como su gobierno antagónico y el entorno político donde no eran evidentes, del todo, los espacios de participación ciudadana estuvieron en contra de este movimiento. Explican también que las relaciones causales existentes entre la acción colectiva del movimiento LGBT y sus logros para vencer estas adversidades logró transformar leyes que restringían sus libertades que, con la lucha constante han construido un espacio público e institucional libres de discriminación. Aseguran que esta obra puede leerse también como el estudio del conjunto de estrategias que fueron llevando a un grupo de la sociedad civil a construir las bases que en materia legislativa han logrado cambios que años atrás hubieran sido impensables. Sugieren una lectura obligada para estudiosos de movimientos sociales, organizaciones civiles y activistas, que buscan la transformación legal y cultural en contextos diversos.
