Excerpt from Criminal Responsibility Although, therefore, the subject of criminal responsi bility has been considered and treated exhaustively, by Sir Fitzjames Stephen, from the point of view of the professional lawyer who was in psychology an amateur, it seems that its treatment is not complete until it has been considered anew by a professional psychologist. Sir fitzjames Stephen was hampered by an insufficient knowledge of the working of the mind in health and disease. That he was so hampered he formally admits, and the admission is no disparagement to him. He made the best use of the knowledge of his time, and he obtained a singular degree of mastery over the knowledge of insanity that was then available. But in twenty years our knowledge has advanced; and I think the time is ripe to complement his work by another, written from the complementary point of view. Excerpt from An Analysis Criminal Liability The principles and illustrations employed are mainly drawn from English Law; but I have not, of course, omitted anything which was to be found in the Corpus J uris, bearing upon my subject: and I am not without hope that I may subsequently enlarge this work by comparing some of the rules, of principle or practice, in bodies of modern continen tal law. Reserving, however, such a treatment of my subject for the future, I have at present purposely avoided the quota tion of many parallels, which will probably occur to my readers, from the Code Napoleon or similar sources. Excerpt from The Universal Illusion of Free Will and Criminal Responsibility The consciousness that man has of his free will is the only argu ment used by the champions of free will. This is a veritable sophism. Even to-day the few scientists defending this view still have recourse to it. They say: In the name of an auto-observa tion, bereft of all apriorism, it is easy to observe that the normal man, in a state of full mental activity, has in himself the impres sion, the consciousness that he can resist or give way to solicita tions which lead to good or evil. This sense of moral liberty is a natural attribute to the human organisation. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from The Criminal Responsibility of Lunatics: A Study in Comparative Law, Thesis Approved for the Degree of Doctor of Laws in the University of London The feud between medical men and lawyers in all questions concerning the criminal liability of lunatics is of old standing. More than one authority on either side has tried to bring about a reconciliation between the contending parties. But their endeavours have been crowned with very little success. For though it cannot be denied that the strife and warfare has of late lost much of its former bitterness, a modus vivendi satisfactory to both parties has not been found. Discouraged by such experiences, others have thought it well-nigh impossible to bridge over the gulf which in their opinion must ever separate the two hostile camps; they think that the visual angle from which the two professions look at the problem is too different to allow of a solution acceptable to both. I do not share this pessimistic view, nor the policy of the laisser faire which is its logical outcome. If all attempts hitherto made to bring the dispute to a peaceful ending have failed, and were doomed to failure from the very outset, the reason is not far to seek. Almost all the writers who have approached the investigation in a conciliatory spirit, have sought success by forsaking the claims of their own professional brethren and blindly recognising the opponents' claims; and surely deserters do not make good peace-makers. Yet in no other way could those writers hope to reach their goal. For how is the lawyer to distinguish between fact and hypothesis in the literature of psychological medicine? Excerpt from Responsibility for Crime: An Investigation of the Nature and Causes of Crime and a Means of Its Prevention The following dissertation is the outcome of a three years' study of the subject of crime in all its phases on the general basis of Professor Giddings' explanation of society as a product of like response to stimuli. A study of the works of the so-called Italian School of Criminal Anthropologists and of those of their foremost American contemporaries resulted in the working-out of the writer's own theories in regard to crime and the crim inal set forth herein. Owing to the widespread aversion to the subject in general, a special effort has been made to present it in as popular phraseology as possible. Under the impression that reforms can come only as a result of a gen eral understanding of the situation in the minds of the people. This effort accounts for a notable lack of scientific expression in the work, popular terms being substituted for technical ones wherever possible. The works of Lom broso and Maudsley have been of exceptional value, as have those of E. Ferri, Havelock Ellis and Dr. Drahms. Spe cial thanks are due to Dr. Giddings for his kindly interest. Excerpt from Crime and the Family While these discussions on prisons and criminal re forms have been prosecuted, little or no attention has been given to this terrible fact - the existence of crime itself. The existence of crime and criminals has seemed to be regarded as the necessary products of social development. Hence no investigations have been prosecuted to* search out the origin and source and cause of this terrible social evil, and ascertain, if possible, upon whom rested the responsibility that criminals were, somewhere in the bosom of society, being constantly educated into a life of crime. This subject is of the deepest moment, and an effort to fathom it can not fail to do good. It will at least open up the inquiry, and point out the mode of its proseca tion. These criminals were once innocent babes, drawmg their life from a mother's breast. They were once in the family, and have come forth from it, not to adorn and bless, but to prey upon society. By whose fault and neglect does this take place? And how can it be prevented, if prevented it can be? In the following'work, I shall endeavorto furnish a solu tion to these all-important questions, by endeavoring to ascertain the origin and cause of crime, and the manner in which these cau'ses may be removed, and the education of criminals prevented.
