The great civilizations of the world are very different from one another, indeed more strangely different the closer they come in economic, social, and cultural interaction. Yet each claims to be a normative way of being human. At the very minimum human achievement requires competence in the conventions of one's own civilization. To be human is to participate in a conventional culture, and the normatively human conventional cultures are different. Here is the "clash of civilizations": Without commitment to some conventions of civilized humanity, no one can be human; yet the conventions are different, perhaps even opposed. Two problems bring philosophy to the refiner's fire. How can we conceive of human culture across the differences of civilized cultures? This is a problem about the nature of theory itself. It calls for a new theory of theorizing that at once provides synoptic understanding and recognized differences and incommensurabilities. Many postmodern critics have thundered against theories that oppress by the value-laden bias of their own forms, and by the interest guiding their forms. Neville provides a theory of theories that responds to these challenges and addresses the problem of theorizing across different cultures. The other problem is how to exercise practical reason across cultures expressive of different civilizations. How can human beings be responsible in a world where all values seem culture-bound and the obvious solution seems to be moral relativism that trivializes responsibility? Neville presents a theory of practical reason oriented to objective norms determined cross-culturally and based on a Confucian sense of the ritual character of the most important levels of moral life. This book completes Neville's series, Axiology of Thinking, a trilogy of systematically related studies of valuation in four kinds of thinking: imagination, interpretation, theorizing, and the pursuit of responsibility. Reconstruction of Thinking and Recovery of the Measure, both published by SUNY Press, are companion volumes.

This book develops a queer methodology to analyse a queer archive for the impact of normativity on subjecthood and the ways in which it shapes and curtails gender and sexuality. Chapters demonstrate how normativity functions to mask its own operation, is internalised by subjects, and is continually reproduced through discourse and in material ways. In seeking to make visible the functioning of normativity, the book performs a task of queering normativity by querying that which appears as natural in South Asian public culture. With regard to family law, this volume examines claims based on cultural tradition, ethnic background, custom, religious affiliation and sexual orientation, as well as various other “claims” that are not officially recognized in state law, in 15 jurisdictions around the world. The country reports seek to determine whether these claims represent a challenge to family law as conceived by the state, and if so, how these challenges are being managed. The focus lies on the interaction between (i) claims and traditions raising minority-related and diversity-related issues and (ii) the state as the addressee of these demands for accommodation. The reports identify specific instances and situations that have proven (and in many cases still are) particularly difficult to resolve. They force decision-makers to engage in a delicate balancing act between different, often clashing interests.

The field of socio-legal research has encountered three fundamental challenges over the last three decades – it has been criticized for paying insufficient attention to legal doctrine, for failing to develop a sound theoretical foundation and for not keeping pace with the effects of the increasing globalization and internationalization of law, state and society. This book examines these three challenges from a methodological standpoint. It addresses the first two by demonstrating that legal sociology has much to say about justice as a kind of social experience and has always engaged theoretically with forms of normativity, albeit on its own empirical terms rather than on legal theory’s analytical terms. The book then explores the third challenge, a result of the changing nature of society, by highlighting the move from the industrial relations of early modernity to the post-industrial conditions of late modernity, an age dominated by information technology. It poses the question whether socio-legal research has sufficiently reassessed its own theoretical premises regarding the relationship between law, state and society, so as to grasp the new social and cultural forms of organization specific to the twenty-first century’s global societies.

Humans are justificatory beings - they offer, demand, and require justifications. The rules and institutions they follow rest on justification narratives that have evolved over time and, taken together, constitute a dynamic and tension-laden normative order. In this collection of essays, the first translation into English of the ground-breaking Normativitat und Macht (Suhrkamp 2015), Rainer Forst presents a new approach to critical theory. Each essay reflects on the basic principles that guide our normative thinking. Forst's argument goes beyond 'ideal' and 'realist' theories and shows how closely the concepts of normativity and power are interrelated, and how power rests on the capacity to influence, determine, and possibly restrict the space of justifications for others. By combining insights from the disciplines of philosophy, history, and the social sciences, Forst revaluates theories of justice, as well as of power, and provides the tools for a critical theory of relations of justification.
