Insbesondere verstärken die Banken ihre Bemühungen, die Kunden an ihre Unternehmen zu binden und somit größere Cross-Selling Potentiale schaffen zu können. Im Rahmen dieser Kundenbindungsmaßnahmen haben die Banken erkannt, dass Reklamationen und Beschwerden eine größere Bedeutung zukommt, als bisher angenommen. Wurden bislang Beschwerden als lästig und zusätzliche Arbeit empfunden, so nutzen heutzutage die Banken verstärkt diese Kundenreaktionen als Feedback und zusätzliche Quellen zur Informationsgewinnung über die Qualität ihrer Produkte. Nahezu alle Finanzdienstleister haben deshalb inzwischen ein eigenes Beschwerdemanagement aufgebaut und in ihr Unternehmen eingeführt. „Deutsche Kreditinstitute liegen beim erfolgreichen Beschwerdemanagement vorn. Gut jeder zweite Kunde ist mit dem Ergebnis seiner Beschwerde meistens zufrieden.“ Dies ist eine recht zufriedenstellende Aussage, mitunter auch darin begründet, dass seit etwa 10 Jahren Ombudsmänner beim Bundesverband Deutscher Banken (BdB) über Beschwerden schlichten können. Doch im Vergleich zur Mediation ist eine Schlichtung immer durch eine Entscheidung des Ombudsmannes gekennzeichnet. Dies schafft Raum für weiteren Unmut und Unzufriedenheit bei den Parteien, was sich letztendlich in einem teuren Gerichtsverfahren oder aber einer Auflösung der Kundenbeziehung auch nach einem Schlichtungsspruch äußern kann. In dieser Arbeit möchte ich deshalb die Frage klären, ob man Mediation ins Beschwerdemanagement der Banken einbinden kann und welche Vorteile sich hieraus ergeben können. Dazu werde ich erläutern, was Mediation ist und wie ein solches Verfahren abläuft. Nach Klärung des Beschwerdebegriffs werde ich dann Einsatzmöglichkeiten der Mediation im Beschwerdemanagement aufzeigen.

Durch die Veränderung von Märkten und Produkten durch die Globalisierung und der dadurch zunehmenden Konkurrenz stehen Banken mehr denn je unter Druck. Zusätzlich wurden im Nachgang zur Finanzkrise 2009 neue Regularien eingeführt, Gerichtsprozesse, hohe Strafzahlungen und die Diskussion um „gierige Spekulanten“ und zu hohen Managergehältern in der Presse führten zu einem Verlust an Reputation und Profitabilität. Dies hat sich auf Häufigkeit und Tragweite der Konflikte zwischen Banken und ihren stetig selbstbewusster werdenden Kunden negativ ausgewirkt, so dass diese sich immer öfter vor Gericht streiten. In dieser Studie wird untersucht, welche Konflikte mit Hilfe außergerichtlicher Verfahren im Hinblick auf Kundenzufriedenheit, Vertrauensbildung, Streitkosten, Zeitaufwand sowie Öffentlichkeitswirksamkeit effizienter gelöst werden können, als durch Litigation. Dabei werden die Chancen und Risiken verschiedener Alternativen aufgedeckt. Der Schwerpunkt des Buches liegt dabei in einer kritischen Betrachtung der Mediation. Darüber hinaus werden konkrete Handlungsempfehlungen zur Konfliktbeilegung dargestellt.

The objective of this guidance on fulfilling the reporting requirements of Article 12 of the Code of Conduct is to obtain a regular flow of information on its observance to strengthen implementation of the Code, to provide data for its future revisions and improvement, and, most importantly, to improve the protection of human health and the environment related to pesticide use and management in agriculture and public health. The guidance was prepared in compliance with the FAO/WHO International Code of Conduct on Pesticide Management, which sets out a framework and voluntary standards of conduct for stakeholders in pesticide management, in particular governments and the pesticide industry. Endorsed by FAO, WHO, governments, pesticide producers, non-governmental organizations and other stakeholders, the Code outlines their shared responsibility to promote best practice and risk reduction throughout the pesticide life cycle. The Code of Conduct thereby establishes the commitment and moral obligation of stakeholders to comply with the agreed standards of conduct and to assume their respective responsibilities. These include governments’ responsibility to promote pesticide risk reduction and the industry’s responsibility to produce products that are adapted to the context of their use and to provide stewardship of those products throughout their life cycle. This guidance was prepared with the support of the FAO/WHO Joint Meeting on Pesticide Management (JMPM) to provide further guidance on the provisions of the Code of Conduct related to its observance and implementation. It reflects the joint FAO/WHO approach to pesticide management, thus addressing the topic in both agricultural and public health settings.

Across Europe, land is constantly the subject of enormous and widely varied pressures. The land we have is shrinking in area due to numerous reasons, including those that are directly related to climate change and migration. In fact all disciplines that have responsibilities for the husbandry use, management, and administration of the land are forced to address the problems of how to plan and how to utilise this increasingly valuable resource. The papers contained within this book emerge from two symposia held in 2014 and 2015, which now have been arranged along four general themes reflecting the multi-disciplinary nature of the disciplines concerned with land. The first part is dedicated to the interpretation of key terms in their context and the dissimilar conceptual approaches in the governance of different states. It is followed by papers that identify the process of decision-taking: how to organize and co-operate. One large section addresses the identification of land pattern changes and the reason for it. The papers in the final cluster deal with the general theme of strategies and measures used to steer future evolution in land policies.
