Das vor 20 Jahren – am 1. Juli 2002 – in Kraft getretene Designgesetz (DesG) hat das Muster- und Modellgesetz (MMG) aus dem Jahre 1900 ersetzt. Dies war ein Meilenstein in der Geschichte des Designschutzes, der die Grundlage für einen zeitgemässen und adäquaten Rechtsschutz legte. Der vorliegende, nun bereits in zweiter Auflage erscheinende Kommentar erläutert die Gesetzesbestimmungen aus der Sicht der Praktikerinnen und Praktiker. Er berücksichtigt die aktuelle Rechtsprechung und die zum DesG über die vergangenen zwei Jahrzehnte veröffentlichte Literatur und nimmt Bezug auf die anderen schweizerischen Immaterialgüterrechtsgesetze, die EU-Gesetzgebung und die relevanten multilateralen Abkommen, insbesondere das Haager Abkommen. Die seit dem Inkrafttreten des DesG erfolgten Gesetzes- und Verordnungsänderungen sind ebenfalls aufgeführt. Il rassemble les contributions qui ont été rédigées à l’occasion de la Journée de Droit de la Propriété Intellectuelle (www.jdpi.ch) organisée le 5 février 2015 à l’Université de Genève sur le thème « Le droit du design / Design Law ». Il ne fait pas de doute que l’apparence extérieure des produits qui nous entourent est susceptible d’exercer une force d’attraction importante, voire une fascination sur le public des consommateurs. Preuve en est la valeur phénoménale progressivement acquise par une firme californienne à la désormais célébrissime pomme – qui était, il faut le rappeler, au bord du gouffre il y a quelques années –. Cette firme a en effet su inventer ou réinventer des produits technologiques à destination de tous à la ligne épurée et attractive, qu’il s’agisse de téléphones, de tablettes ou d’autres produits électroniques. Il est certes clair que l’attractivité de ces produits ne tient pas exclusivement à leur apparence, mais également à leur convivialité et fonctionnalités technologiques. On ne peut toutefois pas doutes que leur « look » y contribue aussi (largement). Il n’est dès lors pas surprenant que nombre d’entreprises dans des secteurs et industries très variés consacrent d’importantes ressources et leur énergie créatrice à développer des produits au design unique, destiné à les distinguer de ceux de leurs concurrents. Comment le droit du design peut-il dès lors protéger cette créativité des produits et à quelles conditions ? Juger du pouvoir d’attraction de la forme d’un produit n’est pas tâche aisée. C’est en somme tenter de faire écho sur le plan légal à la phrase du célèbre designer Milton Glaser : « There are three responses to a piece of design : yes, no and … WOW. WOW is the one to aim for ». Pour explorer le domaine évolutif du droit du design, les auteurs des remarquables contributions qui composent ce livre se sont penchés sur diverses facettes de la thématique en droit international et national. Qu’ils soient chaleureusement remerciés pour leur précieux travail et que M. Pierre Heuzé qui s’est chargé des tâches d’édition du livre trouve ici aussi l’expression de ma vive reconnaissance.

This publication examines the legal aspects of the spare parts market from an IP perspective: specifically whether design protection for spare parts of a complex product extends to the spare part aftermarket, or whether that market should remain open to competition. The stakeholders’ equally weighty arguments that must be balanced against are, on the one hand, the property interest in an earned IP right in the design of the part; and on the other, enhanced competition, likely reflected in lower prices. The mounting tension between these two positions is manifest an increased number of lawsuits in both the US and the EU. This book provides a discussion of the legal issues involved in this debate from a global perspective, with special focus on the EU and the US. Part I contextualizes the legal debate by discussing the historical background, the competitive situation and the respective stakeholder positions. Part II examines the relevant legal questions on a comparative basis, evaluating the likelihood of its adoption in the jurisdictions examined. Concluding that adoption is unlikely, Part III proposes a number of possible considerations meant to further compromise. 'Intellectual property and private international law' was one of the subjects discussed at the 18th International Congress of Comparative Law held in Washington (July 2010).
