Die nach dem Ort ihrer parlamentarischen Beratung und Verabschiedung gemeinhin als „Bamberger Verfassung“ titulierte bayerische Verfassung vom 14. August 1919 stellt das erste demokratische, auf dem Prinzip der Volkssouveränität basierende Grundgesetz Bayerns dar, welches auch die Ausgestaltung der heute gültigen Landesverfassung von 1946 wesentlich beeinflussen sollte. Gleichwohl wurde der Bamberger Verfassung im öffentlichen Bewusstsein und in der Forschung bislang nur vergleichsweise geringe Beachtung zuteil, wobei nicht zuletzt deren komplexe Genese fast völlig im Dunkeln lag. Vorliegende Studie setzt sich daher das Ziel, den schwierigen Prozess der Verfassungsentstehung zwischen November 1918 und August 1919 vor dem Hintergrund der krisenhaft zugespitzten politischen Ausnahmesituation jener Monate in Bayern zu rekonstruieren und mit einer Analyse der zentralen materiell-rechtlichen Aspekte zu verbinden. Im Sinne einer doppelten komparatistischen Perspektive wird einerseits auch die zeitgleiche staatsrechtliche Entwicklung auf Reichsebene sowie in anderen deutschen Ländern in den Blick genommen und andererseits die Bamberger Verfassung im Gesamtzusammenhang der bayerischen Verfassungsgeschichte seit 1818 beleuchtet.
