Diese Untersuchung ermittelt die Vorgaben, die bei der Vergabe nachrangiger Dienstleistungsaufträge beachtet werden müssen und stellt einen Reformvorschlag vor. De lege lata müssen das unionsrechtliche Sekundärrecht und das einfache nationale Recht eingehalten werden. Vor allem die VOL/A gibt einen umfassenden Regelkatalog vor. Weniger Regeln enthält hingegen die VOF. Das übergeordnete Recht ergänzt die zum Teil spärlichen Regeln des einfachen Rechts. Insbesondere die Vergabe von nachrangigen Dienstleistungsaufträgen, die sich nicht nach der VOL/A richtet, wird so einem umfassenden Vergaberegime unterstellt, das auch die Gewähr von Rechtsschutz umfasst.
