É neste jogo de questionamento dos antagonismos existentes entre a teoria e a prática, a formalidade e a informalidade, a liberdade e a razão, a práxis e a técnica, que se descobre a necessidade de se tematizar os direitos sociais, políticos, econômicos e culturais. 18 No Brasil, urge esta opção preferencial pelas minorias, na conquista de espaços maiores de afirmação e reconhecimento, em prol da igualdade substancial. Observa-se a existência de uma pluralidade de culturas e de que há a abertura de um universo múltiplo, complexo e heterogêneo, marcado pela diversidade e diferentes instâncias que formam a sociedade civil e política, que diminuem ou suprimem o papel do Estado enquanto agente instituidor social e fonte exclusiva do direito. De fato, o Estado historicamente não pode ser considerado como a única forma de organização social, uma vez que muitas sociedades viáveis viveram sem ele. As sociedades modernas, embora sejam estatais, ainda assim apenas parcialmente são vistas como estatizadas. Esta obra resgata os problemas envolvidos na relação entre o Multiculturalismo e o Pluralismo Jurídico, que não foram divulgados por razões históricas, culturais, econômicas e interesses das elites dominantes, em resumo, da estrutura societária e do perfil populacional. É um tema apaixonante, pois trata da construção de um novo paradigma em confronto com os modelos tradicionais e a dogmática jurídica, com suas hierarquias funcionais, autoritárias e tradicionais. Postula-se na presente obra a construção e a defesa de direitos de conteúdo emancipatório, marcado pelas lutas e reivindicações dos setores excluídos das camadas da população brasileira.
