This research evaluates whether the new model of investment agreement developed by Brazil (CFIA) is a mechanism for enhancing protection and respect for social and economic rights. The research starts by exploring the origins of investment treaties, their development and main characteristics. It examines why investment treaties and socio-economic rights are related, by mapping cases in which investment treaties have already impaired the protection of such rights. The research then analyzes how these two issues shall be jointly handled. It considers international organizations? initiatives to regulate business and human rights and investment treaties? frameworks that foster sustainable development, as well as new investment agreements? models developed by different countries, and then suggests criteria for evaluating whether an investment treaty is adequate from the socio-economic rights standpoint. Finally, this research investigates the CFIA model, brings a brief historical overview, evaluates CFIAs? wording, and examines how some CFIAs? institutional mechanisms consider corporate social responsibility issues. In conclusion, this research asserts that the CFIA model can be a mechanism for enhancing protection and respect for socio-economic rights, but some concerns (particularly related to safeguarding States? regulatory space and providing for stronger obligations to investors and States to protect human rights) need to be addressed.

É com muita alegria que organizamos o quarto volume desta obra coletiva intitulada Direitos Humanos e suas Tramas: Olhares Plurais, com a finalidade de fomentar o aprofundamento das pesquisas sobre os direitos humanos através de diferentes perspectivas. Em referência à temática das diferentes dimensões envolvidas no âmbito dos direitos humanos, J. J. Gomes Canotilho (2003) ensina que “os direitos do homem não se baseiam apenas em grandezas invariáveis jusnaturalisticamente formuladas”, sendo “patente a sua conexão com as constelações histórico-sociais”. Assim, “se o capitalismo mercantil e a luta pela emancipação da sociedade burguesa são inseparáveis da consciencialização dos direitos do homem, de feição individualista, a luta das classes trabalhadoras e as teorias socialistas (sobretudo Marx, em A Questão Judaica) põem em relevo a unidimensionalização dos direitos do homem egoísta e a necessidade de completar (ou substituir) os tradicionais direitos do cidadão burguês pelos direitos do homem total, o que só seria possível numa nova sociedade”. Independentemente da adesão aos postulados marxistas, pondera o constitucionalista português, “a radicação da ideia da necessidade de garantir o homem no plano económico, social e cultural, de forma a alcançar um fundamento existencial-material, humanamente digno, passou a fazer parte do património da humanidade”. Destarte, “as declarações universais dos direitos tentam hoje uma coexistência integrada dos direitos liberais e dos direitos sociais, económicos e culturais, embora o modo como os Estados, na prática, asseguram essa imbricação, seja profundamente desigual”. Hodiernamente, os direitos humanos possuem relevância global. Conforme preleciona Louis Henkin (1993), “subsequentemente à Segunda Guerra Mundial, os acordos internacionais de direitos humanos têm criado obrigações e responsabilidades para os Estados, com respeito às pessoas sujeitas à sua jurisdição, e um direito costumeiro internacional tem se desenvolvido. O emergente Direito Internacional dos Direitos Humanos institui obrigações aos Estados para com todas as pessoas humanas e não apenas para com estrangeiros Este Direito reflete a aceitação geral de que todo indivíduo deve ter direitos, os quais todos os Estados devem respeitar e proteger. Logo, a observância dos direitos humanos é não apenas um assunto de interesse particular do Estado (e relacionado à jurisdição doméstica), mas é matéria de interesse internacional”. Não obstante a ênfase desta obra coletiva na abordagem jurídica de seu objeto de pesquisa, advertimos o leitor para o intuito transversal de seus variados capítulos.
