A proteção de minorias étnicas, religiosas e linguísticas sempre foi um tema de preocupação do direito internacional. Contudo, a necessidade dos direitos específicos das minorias e a sua codificação foram marcados por resistências, por parte dos Estados, e ainda são motivo de controvérsia e dificuldades de efetivação. Nesse contexto, o presente estudo tem por objetivo analisar se a proibição da discriminação, aliada aos direitos humanos universais, são suficientes para assegurar uma adequada proteção às minorias no direito internacional, discorrendo-se, em um primeiro momento, sobre o histórico da proteção de minorias no direito internacional, de Augsburgo ao sistema estabelecido no contexto da Liga das Nações. Na sequência, aborda-se como a recém instaurada Organização das Nações Unidas tratou o tema nos seus auspícios, bem como destacam-se as tentativas de conceituação do termo minoria intentadas por essa Organização. Posteriormente, disserta-se acerca da proteção da existência e da identidade das minorias, abordando-se os principais tratados e dispositivos internacionais e regionais que reconhecem tais direitos específicos. Por fim, examinam-se os aspectos gerais do princípio da não discriminação no direito internacional e a sua posição em um direito internacional pós-moderno. Conclui-se que uma adequada proteção de minorias no direito internacional deve ser construída com base em dois pilares: de um lado, a proteção e promoção da identidade e da existência das minorias e, de outro, o direito antidiscriminação e os direitos humanos universais.

We are publishing this book as the result of a research project carried out by the University of Las Palmas de Gran Canaria in Spain and AFM Krakow University in Poland. Some parts of it were already announced during a scientific Conference organised remotely in Kraków in October 2020. It is now time to present the research findings in writing.The issue of Artificial Intelligence has long raised questions and interests, including those of legal science. A number of problems have not yet been widely analysed, despite the fact that the present time is undoubtedly a time of technological challenges.
