One of the main demands of Vatican II Council with respect to Canon Law was to always focus on the mystery of the Church. This clear and distinct position led to a renewal of the methodology applied to the discipline of Canon Law in almost all post-conciliar "schools". The canonistic demand however, similarly to change the didactic tools, the teaching material, in this new context has proved to be less significant. Knowing the importance and the urgency of this initiative has been a strong source of motivation to the author. The leading and inspiring idea behind this initiative is the conviction that the formal principles of Canon Law, both as the inner structure of the Church community as well as a proper scientific method, are the three fundamental elements of the constitution of the Church: the Word, the Sacrament and Charisma.

Canon 1371, 2 calls for a just penalty to be imposed upon one who is persistently disobedient to a command or prohibition imposed by the apostolic see, an ordinary or other superior. With the goal of arriving at an authentic understanding of the canon, this work begins with a study of the fonts attributed to it, consisting of decisions rendered by pope or a dicastery. A historical approach continues in chapter two, with an examination of relevant CIC 1917 legislation. In addition to a detailed analysis of canon 1371, 2 this work considers jurisprudence of the Roman Curia, presented under the themes of disobedience to the Apostolic See or to one's ordinary; the value and importance of obedience; the need for competent authority to be vigilant and intervene when necessary; and now this intervention can serve as a pastoral instrument for the salvation of souls. This work also undertakes a contemporary and practical reading of canon 1371,2 pointing out that the precept or prohibition imposed must be legitimate, that persistent disobedience must be present, and that the imposed penalty is to be just. It offers conclusions as to why the canon is important for the Church today. Obedience to competent authority on the part of the Christian faithful provides a healthy example to those outside the Church and can help protect the faithful. Proper implementation of what is called for in canon 1371,2can prevent more grave disobedience in the future and promote good order in the Church.

This study examines the nature and content of the right of the faithful expressed in can. 1214 to enter a church for the purpose of exercising divine worship, and considers how the jurisprudence of the Holy See can be applied to restrictions placed upon the exercise of that same right. Specifically, this work addresses four questions: 1) What is the right of entry into churches for the exercise of divine worship, as expressed in can. 1214? 2) Who may restrict the exercise of this right? 3) For what reason may it be restricted? And 4) How far may it be restricted? Two important distinctions are present throughout the course of this study. The first is between the actual extinction of the right of entry relative to a given church edifice and the mere restriction of the exercise of that same right, The second distinction is between the objective right of entry, static in nature and defined by law, and the corresponding subjective right, able to be exercised and therefore subject to restrictions. As this study demonstrates, prior to the 1917 Code, the right of entry developed separately in regard to churches and in regard to oratories. A textual study of both the 1917 and 1983 Codes examines not only the objective right of entry, but also related canons which did or still do affect the exercise of the corresponding subjective right. This work identifies key elements of the jurisprudence of the Holy See concerning the extinction of the right of entry relative to individual churches, and then explores how that same jurisprudence could be applied to the mere restriction of the right, rather than to its extinction. A practical method is proposed for assessing the lawfulness of such restrictions. The study concludes with a look toward the future.
