Una vida con discapacidad -originaria o sobrevenida- es un modelo de resiliencia, fortaleza y superación. La discapacidad es una voz del cuerpo y de la mente que nos alerta acerca de la fragilidad y de la fugacidad de la vida. La historia de España tiene una deuda pendiente con la discapacidad: ¿Conseguirá saldarla la nueva legislación? Esperemos que la educación jurídica y la pedagogía social; la conciencia institucional y la buena praxis profesional; así como la investigación científica -en todas las ramas del conocimiento científico (en especial, de la Medicina y el Derecho)- estén a la altura de la nueva concepción de la Discapacidad. Este libro incorpora un detallado estudio sobre el nuevo paradigma de la Discapacidad (único concepto -por cierto- que ha provocado, durante nuestra ya madura democracia, una reforma constitucional) provocado por la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica. En sus diversos capítulos -redactados por académicos y aplicadores del Derecho especialmente comprometidos en su “día a día” con este modelo de resiliencia, fortaleza y superación (esencialmente Fiscales, Abogados, Trabajadores Sociales y Médicos)- se afronta el empeño de diseccionar todos y cada uno de los pasos jurídicos de las personas con discapacidad; y ello desde el incipiente momento en que la causa de discapacidad todavía no ha debutado -con los poderes preventivos ante Notario- hasta el encarnizado momento en que el Juez -de la Jurisdicción contenciosa debe imponer un apoyo a la persona con discapacidad, pasando por todas y cada una de esas -más livianas- fases de desjudicialización y proclamación del propio apoyo -autocuratela- o de matizada judicialización con la provisión del apoyo en una sede tan ágil, sencilla y humana como la Jurisdicción Voluntaria.
