Une telle norme produit des effets notables : reconnaissance d'un droit à l'objection de conscience ; annulation d'actes contraires ; fondement aux limitations des droits fondamentaux ; incitation à agir pour les autorités constituées ; limite aux actions attentatoires aux animaux ; référent pour l'activité interprétative.D'autres pays, les plus nombreux, ne comportent pas de disposition constitutionnelle spécifique. Un fondement est alors recherché dans les dispositions protectrices des personnes et dans celles protégeant l'environnement. À défaut de reconnaissance, le contentieux constitutionnel animalier s'analysera pour l'essentiel en un contentieux de la constitutionnalité des textes qui visent, soit à protéger l'animal, soit à en encadrer les modalités de son utilisation.

Constitutional animal law has become increasingly important in recent years. Some countries, such as Germany, Brazil, Luxembourg and India, have included a specific provision for the protection of animals in their constitutions. Such a provision has a number of notable effects: the recognition of a right to conscientious objection; the annulment of contrary acts; a basis for the limitation of fundamental rights; an incentive to take action; a limit on actions harmful to animals; a referent for the application and interpretation of the law; and a basis for legitimising criminal offences. However, most countries do not have a specific constitutional provision. In these cases, a basis is sought in provisions protecting the environment, recognising the rights of nature, enshrining the right to life or protecting people. In the absence of such recognition, constitutional litigation concerning animals focuses mainly on fundamental rights, challenging laws that protect animals or regulate the conditions of their use.

La loi n° 2015-177 du 16 février 2015 a défini les animaux comme des " êtres vivants doués de sensibilité ", marquant une évolution du droit français. Ne bénéficiant ni de la personnalité juridique, ni d'un régime juridique nouveau, les animaux demeurent néanmoins, sous réserve des lois qui les protègent, soumis au régime des biens. Cet ouvrage invite à refondre la catégorie des personnes afin d'y intégrer l'animal, favorisant la création d'un régime juridique cohérent et efficace. Le droit français distingue aujourd'hui les personnes morales des personnes physiques. Parmi ces dernières, il est proposé de créer, à côté des personnes humaines, la catégorie des personnes non-humaines, distinguant les animaux des hommes. Les interventions assemblées dans cet ouvrage expliquent pourquoi cette proposition de création d'une personnalité juridique pour les animaux est non seulement possible, mais également souhaitable. Le législateur apporterait ainsi les réponses théoriques et pratiques aux nombreuses incohérences de notre droit sur la question des animaux.
