Ce livre a pour objet la théorie générale des contrats. Même si l’essentiel des développements porte sur le droit commun des obligations contractuelles, l’auteur examine aussi les apports des législations qui, en marge des articles 1101 et suivants du Code civil, viennent l’enrichir, le nuancer et souvent y déroger. Une attention toute spéciale est portée aux lois de protection des consommateurs, en particulier à la loi du 6 avril 2010 relative aux pratiques du marché et à la protection des consommateurs. Chacune des étapes de la vie du contrat est retracée, de manière approfondie, à la lumière de la doctrine et de la jurisprudence les plus récentes. Après une introduction consacrée à la notion même d’obligation et à ses sources, l’auteur propose une théorie générale des contrats qui se divise en six parties : • les notions générales relatives au contrat ; • la conclusion du contrat ; • les effets du contrat ; • les sanctions de la méconnaissance des effets du contrat ; • les effets du contrat entre parties et vis-à-vis des tiers ; • la suspension, la modification et la fin du contrat.

Parmi les sources d’obligations, le contrat se taille la part du lion dans le Code civil. Plus de deux siècles après la promulgation du Code, très peu des nombreux articles qui lui sont consacrés ont été abrogés ou simplement amendés par le législateur. Les apparences sont cependant trompeuses. Le droit belge des obligations contractuelles est traversé par de profondes évolutions qui, sur certains points, modifient radicalement sa physionomie primitive. Le sens des textes a souvent changé sous l’action de la doctrine et de la jurisprudence, qui se sont ouvertes à des préoccupations nouvelles. Par ailleurs, le législateur a multiplié les lois en marge du Code, afin, notamment, d’assurer une meilleure protection de la partie faible au rapport contractuel. From the very first negotiations of the International Covenant on Economic, Social and Cultural Rights half a century ago to the present day, socio-economic rights have often been regarded as less enforceable than civil and political rights. The right to adequate housing, even though protecting one of the most basic needs of human beings, has not escaped this classification. Despite its strong foundations in international, regional and domestic legislation, many people are still deprived of one or more of the different key elements that comprise adequate housing. How, then, can international human rights theory and case law be developed into effective vehicles at the domestic level? Rather than focusing merely on possibilities for individualized relief through the court system, The Right to Housing in Law and Society looks into more effective socio-economic rights realization by addressing both conceptual and practical stumbling blocks that hinder a more structural progress at the national level. The Flemish and Belgian housing legislation and policy are used to highlight the problems and illustrate the pathways here presented.
