Did the crisis teach us anything? In practice, yes. For one, examinations in the form of due diligence of real estate assets have become more frequent and more thorough. Activities on the real estate market in Germany are recovering robustly and have almost reached precrisis levels. Thus, the practice of due diligence is increasing correspondingly. However, the literature on due diligence real estate is still exiguous and lacks outright theoretic approaches. This thesis investigates the relevance of due diligence within real estate transactions by contextualizing it within integrated Transaction Cost Theory approaches and its behavioral assumptions. Transaction-cost and agency-theory parameters such as bounded rationality, opportunism and uncertainty offer approaches for describing how due diligence reduces information asymmetries, uncover hidden characteristics, and therefore prevent adverse selection. Bei institutionellen Investoren spielt allerdings auch die Orientierung in Richtung Handel eine Rolle. Aus diesem Grund ist es für denjenigen, der sein Kapital gewinnbringend in eine Immobilie investieren möchte, unbedingt erforderlich, sämtliche Chancen und Risiken des Investitionsobjekts zu analysieren und abzuwägen, ob seine Erwartungen in die Entwicklung des Investitionsobjektes erfüllt werden können. Daneben ist als ein zweites Erfordernis die Gewährleistung der nachhaltigen Wertentwicklung der Immobilie anzuführen. Drittes und für institutionelle Investoren ebenfalls maßgebliches Kriterium ist die Erkennung bzw. das Vorbeugen gegen mögliche Behinderungen bei einer Weitervermarktung. Wichtig ist deshalb, im Vorfeld einer Transaktion ein Maximum an Informationen über das Objekt einzuholen, um mit Hilfe von größtmöglicher Transparenz und Sicherheit die Erfolgschancen der Investition zu erhöhen, den Preis für das Gut „Immobilie“ bzw. das Investitionsobjekt festzulegen und damit auch das einzubringende Kapital zu sichern sowie eine bestimmte Rendite zu erzielen. Im Jahr 2002 investierten geschlossene Immobilienfonds, offene Immobilienfonds, Immobilien AGs, Leasinggesellschaften und ausländische Investoren ca. 281 Mrd. € in Deutschland. Speziell bei offenen und geschlossenen Immobilienfonds wurde im Jahr 2002 ein Rekordmittelzufluss in Höhe von 19,6 Mrd. € verzeichnet, der laut Martin Jochem, Sprecher der Geschäftsführung der Deutschen Gesellschaft für Immobilienfonds (Degi) nach „Neuinvestitionen in renditestarke Objekte“ verlangte bzw. verlangt. Ein Anstieg des Transaktionsvolumens ist auch zukünftig zu erwarten, was neben der zunehmenden Liberalisierung der Märkte auf eine steigende Internationalisierung der zu tätigenden Investitionen, einen gemeinsamen europäischen Markt und die weitere Marktöffnung in Richtung Osteuropa zurückzuführen ist.
